Theplaintiff,LarrySizemore,isapolicemanfortheCityofDickson.HewasonvacationforapproximatelytwoweekswhenhesustainedaheartattackwhilewatchingtelevisionathomeonAugust15,1994. TheplaintifffiledsuitforworkerscompensationbenefitsspecificallyrelyingonthestatutorypresumptionofcompensabilityaffordedlawenforcementpersonnelinT.C.A.751201,whichstates:8 ...thereshallbeandthereisherebyestablishedapresumptionthatanyimpairmentofhealthofsuchlawenforcementofficerscausedbyhypertensionorheartdiseaseresultinginhospitalization,medicaltreatmentoranydisability,shallbepresumed(unlessthecontraryisshownbycompetentmedicalevidence)tohaveoccurredortobeduetoaccidentalinjurysufferedinthecourseofemployment... . Thedefendantansweredanddeniedtheplaintiffhadsustainedacompensableinjury.ThedefendantfurtherfiledamotionforsummaryjudgmentsupportedbyportionsofdepositionsoftheplaintiffandofDr.TaylorMaloneWraywhogavethefollowingtestimony:8 A.0 Myopinionisthereisnocausalrelationshipbetweenhisworkasapoliceofficerandhissubsequentheartattack.8 Q.0 Doyouhaveanopinionwithinareasonabledegreeofmedicalcertaintyastowhatdidcausehisheartattack?8 A.0 Well,theheartattackwascausedbycoronaryatherosclerosis,whichisabuildupoffattyplaqueintheheartarteries. TheplaintiffrespondedwiththecounteraffidavitofDr.MarshallCrenshawwhichstates,inpart:8 Mr.Sizemorescoronaryarterydiseasedevelopedinthesettingofseveralriskfactors.Hehasapasthistoryoftobaccousage.Hehasapasthistoryofhypertension.Hehasapossiblefamilyhistoryofcoronarydisease,and,ofcourse,heisamale.Alloftheseareknownriskfactorsforcoronarydisease.Chronicstressisaknownriskfactorforthedevelopmentofcoronaryarterydisease,andisknowntocauseprogressionofdiseaseinpatientswhoareotherwisesusceptibletoit... . 8 Itisreasonabletoconcludethat,moreprobablythannot,thechronicstressofMr.Sizemoresjobasalawenforcementofficerwasacauseinthedevelopmentorexacerbationofhishypertensionandcoronarydisease,culminatinginthecardiaceventofAugust15,1994. Basedontheaboveevidence,thetrialcourtgrantedthedefendantsmotionforsummaryjudgmentanddismissedtheplaintiffslawsuit. Thereviewofaworkers'compensationcaseisordinarilydenovoontherecordaccompaniedbyapresumptionofthecorrectnessofthefindingsoffactunlessthepreponderanceoftheevidenceisotherwise.T.C.A.506225(3)(2)However,anappealfromasummaryjudgmentorderinaworkers'compensationcaseisnotcontrolledbythedenovostandardofreview,butisgovernedbyRule56,TennesseeRulesofCivilProcedure,Downenv.AllstateIns.Co.,811S.W.2d523(Tenn.1991).Further,nopresumptionofcorrectnessattachestodecisionsgrantingsummaryjudgmentbecausetheyinvolveonlyquestionsoflaw;thus,onappealthereviewingcourtmustmakeafreshdeterminationconcerningwhethertherequirementsofRule56havebeenmet.Gonzalesv.AlmanConstr.Co.,857S.W.2d42(Tenn.1993).
