àOn€January€20,€1995,€plaintiff€filed€this€suit€alleging€that€(1)€underÏT.C.A.€ðð€50„6„231€he€was€entitled€to€modification€of€the€1991€finalÏjudgment€due€to€increased€psychiatric€impairment,€or€(2)€in€theÏalternative,€he€was€entitled€to€benefits€for€a€new€accidental€[psychiatric]Ïinjury€which€occurred€on€September€œ2,€1994.›€€Ìà àThe€trial€court€found€that€plaintiff€had€failed€to€prove€that€he€gaveÏtimely€notice€œto€the€employer€of›€a€new€work„related€œaccident,›€had€failed€toÏprove€a€new€compensable€injury,€and€was€barred€from€reopening€theÏprior€case€for€modification€of€the€award€owing€to€the€doctrine€of€òòresÏjudicata€óóand€the€statute€of€limitations,€since€the€denial€of€permanentÏpsychiatric€disability€in€that€case€was€never€appealed.Ìà àIn€1989€plaintiff€lost€four€fingers€of€his€left€hand€at€work€when€aÏmachine€malfunctioned€and€cut€them€off.€€He€received€medical€care€for€theÏhand€and€psychiatric€treatment€for€post„traumatic€stress.€€When€heÏreturned€to€work€he€was€transferred€to€the€Maintenance€Department,Ïwhere€he€worked€on€machinery€only€when€it€was€œinoperative.›€€He€was€œa›Ïœtrainee,›€œbut›€after€four€yearsðð€training,€œwas›€not€promoted€to€a€permanentÏmaintenance€job€because€he€had€failed€to€develop€the€necessary€skills.€€Ìà àIn€September€1994€the€employer€transferred€him€back€to€operatingÏmachinery.€€He€worked€for€one€and€one„half€hours,€became€upset,€told€aÏmanager€that€he€could€not€return€to€working€on€machinery€because€itÏterrified€him,€and€left.€€€He€went€to€his€psychiatrist,€Dr.€Robert€Demers,Ïwho€sent€a€letter€to€the€employer€on€September€13,€1994€which€advised:ÌÓ  ÓÓÓà8 àð ðIt€has€come€to€my€attention€that€Mr.€Stagnolia€has€beenÏrequired€to€resume€operating€machinery€at€Lincoln€Brass€andÏthis€has€caused€a€resumption€of€symptoms€of€anxiety€andÏdepression€initially€brought€on€by€his€on„the„job€injury€on€aÏpress€at€Lincoln€Brass.€€Therefore,€he€should€immediately€beÏtaken€off€such€machinery€and€resume€his€maintenanceÏposition.€€If€this€is€not€possible,€then€he€should€be€placed€onÏworkmanððs€compensation.ððÌÌÓ  ÓÓÓà àSince€the€plaintiff€had€already€demonstrated€an€inability€to€performÏthe€maintenance€job,€he€was€offered€a€job€as€janitor,€which€he€refused.€Ìà àDr.€Demers€diagnosed€post„traumatic€stress€disorder,€exacerbatedÏby€the€stress€of€returning€to€the€work€of€machine€operator.€€He€opined€thatÏplaintiffððs€job€transfer€was€the€event€that€resulted€in€permanentÏpsychological€impairment,€and€that€plaintiff€has€moderate€impairment€ofÏhis€ability€to€concentrate,€adapt,€function€socially,€and€perform€dailyÏactivities.€€He€assessed€45€„€50€percent€permanent€partial€impairment.Ìà àDr.€Ben€œBurston›,€independent€medical€examiner,€diagnosed€post„traumatic€stress€disorder€and€adjustment€disorder€with€depressed€mood.€ÏHe€assessed€15€percent€impairment.€€Significantly,€he€opined€that€theÏpermanent€psychiatric€impairment€arose€when€plaintiff€first€injured€hisÏhand€in€1989,€and€that€the€job„change€incident€was€merely€œa€temporary›Ïexacerbation€of€that€impairment.€€Ìà àThe€trial€court€held€that€Dr.€Demersðð€letter€to€the€employer€and€theÏemployeeððs€statement€to€a€manager€that€he€could€not€work€on€machineryÏwere€not€sufficient€notice€of€a€claim€for€a€new€workersðð€compensationÏinjury.Ìà àT.C.A.€ðð€50„6„201€œprovides›€that€in€order€to€receive€workersððÏcompensation€benefits,€an€employee€must€give€notice€of€an€injury€to€theÏemployer€within€30€days€after€sustaining€the€injury.€òòœAetna›€Casualty€&ÍSurety€Co.€V.€Long,€óó569€S.W.2d€444€(Tenn.€1978).€€Notice€must€beÏcalculated€reasonably€to€convey€the€message€that€the€employee€has€sufferedÏan€injury€arising€out€of€and€in€the€course€of€employment.€€òòMasters€v.ÏIndustrial€Garments€œMfg›.€Co.,€Inc.,€óó595€S.W.2d€811€(Tenn.€1980).€ÏAlthough€the€plaintiff€told€a€manager€that€he€could€not€work€onÏmachinery,€he€did€not€œinform€the€employer›€that€he€had€sustained€a€newÏwork„related€accidental€injury€or€intended€to€make€a€new€œworkersðð›Ïcompensation€claim.€€òòSee€International€Playing€Card€v.€œBroyles›,€óó381€ÏS.W.2d€888€(Tenn.€1964).€€Therefore,€we€find€the€trial€court€properlyÏdismissed€plaintiffððs€claim€for€benefits€for€a€new€psychiatric€œinjury€forÏfailure€of€the€employee€to€provide€timely€notice.›Ìà àPlaintiff€contends€in€the€alternative€that€he€is€entitled€to€modificationÏof€his€prior€award€for€increase€in€disability€under€T.C.A.€ðð€50„6„231,Ïwhich€provides:ÌÓ  ÓÓÓà8 àà àð ð(2)€If€the€parties€cannot€agree,€then€at€any€time€afterÏsix€(6)€months€from€the€date€of€the€award€an€application€mayÏbe€made€to€the€courts€by€either€party,€on€the€ground€ofÏincrease€or€decrease€of€incapacity€due€solely€to€the€injury.ððÌÌÓ òÏó óHowever,€whether€an€employee€is€justified€in€seeking€additional€medicalÍservices€to€be€paid€by€the€employer€without€consulting€him€depends€uponÏthe€circumstances€of€each€case.€€òòœBazner›€v.€American€States€œIns›.€Co.,€óó820ÏS.W.2d€742€(Tenn.€1991).Ìà àIn€this€case,€the€medical€evidence€indicates€that€the€treatingÏphysician€has€treated€the€plaintiff€for€numerous€psychiatric€problems,Ïsome€of€which€are€work„related€and€many€of€which€are€not.€€TheÏprocedure€to€be€followed€in€these€situations€is€outlined€in€òòœBazner›,€supra,Ïóówhich€holds:ÌÓ
