Thetrialcourtfoundtheplaintiffhadsustaineda25percentpermanentpartialdisabilitytothebodyasawholeastheresultofaninjuryshesufferedatwork. Thedefendanthasfiledanappealfromthejudgment.Theplaintiffhasmovedtodismisstheappealbecausethedefendantfailedtotimelyfileanoticeofappeal. Wefindthattheappealwasnottimelyfiledandthereforedismisstheappeal. Thejudgmentinwhichtheplaintiffwasawarded25percentdisabilitywasenteredonNovember19,1996.OnDecember23,1996,thedefendantfiledamotionforrelieffromthejudgmentunderRule60.02(1)and(5),Tenn.R.Civ.P.Thedefendantsonlybasisforreliefunderthisrulewasthatthefailuretotimelyfileanoticeofappealwasinadvertent.Counselassertedshethoughtthenoticehadbeenfiledandwassurprisedtolearnithadnotbeenfiled. OnDecember27,1996,thedefendantfiledamotiontohavethetrialcourtenterafinaljudgmentinthecase.Inthatmotion,thedefendantassertedthetrialcourtsjudgmentofNovember19,1996wasnotfinalbecauseitdisposedoflessthanalltheclaimsraisedbytheplaintiffintheoriginalpetition. Thedefendantsmotionassertedthatthetrialcourt,initsjudgment,hadnotdisposedofthefollowingissues:8 (1)Whetherplaintiffisentitledtotemporarydisabilitybenefits;8 (2)WhenplaintiffsdisabilitybecamepermanentwithinthemeaningoftheTennesseeWorkersCompensationLaw;8 (3)Whetherplaintiffisentitledtoreimbursementofmedicalexpensesincurredtodate;and8 (4)Whetherplaintiffisentitledtoalumpsumaward. OnJanuary8,1997,thetrialjudgeenteredanAmendedFinalJudgment. ItisthedefendantscontentionthatunderRule54.02,Tenn.R.Civ.P.,󀛀theϜoriginaljudgmententeredonNovember19,1996wasnotfinal,anduntilthetrialcourthadenteredafinaljudgmentthedefendantcouldnotappealthecaseunderthedirectiveofRule3,Tenn.R.App.P.ThedefendantarguesthatthetimeforfilinganoticeofappealbegantorunonJanuary8,1997,thedateoftheentryoftheAmendedFinalJudgment.OnJanuary23,1997,thedefendantfiledanoticeofappeal. Wedonotfindanytranscriptofanyhearingorincourtproceedinginregardtodispositionofthemotionforentryofafinaljudgment.WenotethatcounselforthedefendantapprovedtheAmendedFinalJudgmentorderforentry,butcounselforplaintiffdidnot. FromthetranscriptofthetrialofthecaseonNovember5,1996inopeningremarks,theplaintiffsattorneystatedthattheonlyissuetobedeterminedwastheamountofanypermanentpartialdisability.Thedefendantdidnotdisputethisstatementorasserttherewereotherissuestobedecided. OnNovember6,1996,thetrialjudge(inwhatisalocalpractice)sentalettertocounselfortheplaintiffandthedefendantsettingouthisfindingsandconclusionsbasedthereon,whichstated,inpart:8 Intheabovecause,theonlyissuefortheCourttodetermineiswhethertheplaintiff,PatsyStedman,hasanypermanentdisabilityrelatedtoafallonMay19,1994atherplaceofemployment. ThejudgmententeredonNovember19,1996,whichincorporatedthefindingsoffactoftheNovember6,1996letterbyreference,wasapprovedforentrybycounselfortheplaintiffandcounselforthedefendant. AnappealdoesnotliefromajudgmentthatisnotfinalunlesspermittedunderRule9andRule54.02,Tenn.R.App.P.TheissueiswhetherthejudgmentofNovember19,1996isafinaljudgment. ThedefendantreliesuponthecaseofAetnaCasualtyandSuretyCo.v.Miller,491S.W.2d85(Tenn.1973),whichholdsthatajudgmentisfinalifalltheissuesbetweenthepartiesraisedinthepleadingshavebeendisposedof.Theplaintiffspetitionraisedsixissues.ThejudgmentofNovember19,1996onlydisposedoftheissueoftheextentoftheplaintiffsdisability. Thedeterminationofwhetherajudgmentisfinalisnotlimitedtoaconsiderationofthepleadingswithoutconsiderationofstatements,agreements,orstipulationsbetweenthelitigantsastheyappearintherecord.Assertionsintherecordbyaparty,whichnarrowtheissuestobedecidedandwhichareacquiescedinbythesilenceaswellastheactionsoftheotherparty,canberelieduponbythetrialcourtindeterminingwhichissuesraisedintheoriginalpleadingsremaintobedecidedinthecourtsfinalorder. Intherecord,thereisnoclaimbythedefendantattrialoratentryofthejudgmentonNovember19,1996thatthereareotherissuestoberesolvedbetweenthem.Theonlyissuelitigatedwasthedegreeoftheplaintiffspermanentdisability.Thedefendantneverassertedtothecourtattrialthattherewereotherissuestoberesolved,andthejudgeslettertocounselsaidthedegreeofdisabilitywastheonlyissuetobedecided.Counselforthedefendantapprovedthejudgmentforentry. Afterthetimeforfilinganoticeofappealhadexpired,counselforthedefendantfiledaRule60motionseekingrelieffromthejudgmententeredonNovember19,1996.Intheaffidavitattachedthereto,counselavoweditwastheintentofthedefendanttoappealfromthejudgment. ItseemspatentlyobviousthatthedefendantconsideredthejudgmentofNovember19,1996tohavedecidedallthejusticiableissuesbetweentheparties.NotuntilDecember27,1996,thedateofthemotionforfinaljudgment,wasthereanyclaimbythedefendantthatthejudgmentofNovember19,1996waslessthanfinal. InthiscasethetranscriptshowsclearlythatthelitigantstryingthecaseϜagreedontheissuestobedecidedandthetrialcourttriedthecaseonlyonthoseϜissues;thecasewastriedontheissuestatedbyonepartytobetheonlyissuetobetried,andtheotherparty,byitsactionsinthecase,impliedlyacquiescedintheϜstatement.Weareoftheopinionthatundersuchcircumstances,afindingbythetrialjudgeontheissueslitigatedandtheentryofjudgmentonthematterslitigated,withoutprotestfromtheotherpartyinthecase,resolvesalltheissuestobelitigatedbetweenthepartiesandbecomesafinaljudgmentunlessthereissomeshowingofmutualmistake,fraudorexcusableneglectbyaparty.
