Therearenoissuesoffactindisputeinthiscase.Allsidesagreethattheplaintiffistotallyandpermanentlydisabledandthathequalifiesforpaymentuntilage65.Becausetheinjuryinthiscasewassubsequenttopreviousinjuries,theSecondInjuryFundincurredliabilityunderTenn.CodeAnn.506208(a).TheemployerandtheSecondInjuryFundagreethattheirliabilityisproperlyapportionedat25percenttotheemployerand75percenttotheSecondInjuryFund. ThetrialjudgeorderedtheemployerandtheSecondInjuryFundtomakepaymentconcurrentlyandamathematicalformulawasreachedwhichwouldfulfilleachofthepayorsliabilityfortheirportionoftheawardwhentheplaintiffreachedage65. Theemployerassertsitsliabilityshouldbelimitedto400weeksandinsiststhetrialcourtproperlyorderedconcurrentpaymentbyitandtheSecondInjuryFund.TheemployerconcedestheseissueswouldberesolvedbythedecisionoftheSupremeCourtinBomelyv.MidAmericaCorp.,___S.W.2d___(Tenn.1998). 5    TheSupremeCourthasdecidedBomelyandtheissuesraisedhereinbytheemployerhavebeendecidedadverselytoit.TheSupremeCourtheldthepercentageofliabilityofanemployerincasessuchasthisshallnotbelimitedtotherelationshipofitspercentageofliabilityto400weeks.Rather,theCourtheldtheliabilitywouldbeapportionedoverthetotalamountoftheawardinaccordancewiththepercentageofliabilityaffixedtotheemployerandtheSecondInjuryFund.Further,theCourtheldthattheemployershallpayitsportionoftheawardfirstandtheSecondInjuryFundshallcommencepaymentwhentheemployerhassatisfieditsliability. ThetrialcourtsjudgmentrequiringconcurrentpaymentbytheemployerandtheSecondInjuryFundandlimitingtheemployersliabilityto25percentof400weeksiserror.Weholdtheemployershallpay25percentofthetotalnumberofweeksoftheawardandtheSecondInjuryFundshallpay75percent.TheemployershallpayfirstandafterthatamountispaidtheSecondInjuryFundshallbegintomakepaymentstotheplaintiff. Theemployerarguesthatitshouldnothavetopayanyinterestontheportionofitsliabilitytotheplaintiffbecauseithasbeenpayingthefullcompensationratefromthetimeoftheendofhistemporarydisabilitysothattheemployeewouldnotbeleftwithoutincome.Weagreewiththeemployerthatitshouldnotpayinterestonthejudgmentduringtheperiodofthepaymentsithasmade.Iftherehasbeenaninterruptionofthosepaymentswhilethiscasehasawaiteddecision,thetrialcourtshall,onremand,determinetheamountofanyaccruedandunpaidliabilitybytheemployerandassessinterestonthatamount. Thetrialcourtorderedcounselfeelsof20percenttobepaidtotheplaintiffsattorneyinlumpsum.Thesefeesarelimitedbystatuteto400weeksor20percentofthesumrepresentedby400weeks.Theemployer/insurancecarrierdidnotmakelumpsumpaymentsoftheaward;theSecondInjuryFunddidastoitspercentageofliability. Theemployerarguesitshouldnotberequiredtopayinterestontheawardforattorneyfeesbecauseithasbeenmakingweeklypaymentstotheplaintiffandtheattorneycouldhavereceived20percentofthisperweekasfees.Theemployersaysthefailureofcounseltodosowasatcounselsoptionanditshouldnotbepenalizedbecausecounselfailedtodothis. Wedonotfindtheactionoftheemployerinnotpayingthelumpsumattorneysfeesparticularlylaudableinthiscasebecauseitsliabilitywasfixedat25percentof400weeksandnotdisputed.Weconcludethereforethattheemployershallbeliableforinterestontheattorneysfeesof20percentinaccordancewiththepercentageofinterestfixedbystatuteontheamountoftheemployerstotalliabilityinthiscase.Thetrialjudgeonremandshallenterwhateverordersthatarefairandequitabletothepartiestocarryoutthisholdingoncounselfees. ThiscaseisremandedtothetrialcourtforentryofsuchordersasarenecessarytocarryoutthejudgmentofthisPanel.
