` Reviewofthefindingsoffactmadebythetrialcourtisdenovouponthe    recordofthetrialcourt,accompaniedbyapresumptionofthecorrectnessofthefindings,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2).Stonev.CityofMcMinnville,896S.W.2d548,550(Tenn.1995). 0p TheapplicationofthisstandardrequiresthisCourttoweighinmoredepththefactualfindingsandconclusionsofthetrialcourtinaworkerscompensationcase.See   Corcoranv.FosterAutoGMC,Inc.,746S.W.2d452,456(Tenn.1988).   ` Thetrialcourtfoundtheplaintiff,apoliceofficer,hadsufferedaheartattackduringthecourseofmakinganarrestofalarge,strongmanwhoresistedtheplaintiffandotherofficerswhenhewasbeingtakenintocustody.Thetrialjudgefoundtheplaintiffhadsuffereda45percentpermanentpartialvocationaldisability. ` Wefindtheevidencedoesnotsupportthefindingthattheplaintiffsufferedaheartattackandreversethejudgment. ` First,wenotethatthiscaseisnotbaseduponTenn.CodeAnn.751201(a)(1)becausecounselfortheplaintiffatthecommencementoftrialarguedtothecourtthatthecasedidnotinvolvethepresumptioncreatedbythatstatute.Therefore,thetrialjudgehelditwasnotnecessarytoaddressthepresumption. Atthetimeoftrial,theplaintiffwasage51andahighschoolgraduate.Hehadpreviouslyworkedinplantsintheareainwhichhelived.In1987,theplaintiffbeganworkfortheMadisonCountySheriffsDepartment.Hisprimarydutywasasajailor. ` OnAugust26,1996,theplaintiffwascalledtothelocalcourthousebecauseofadisturbancebeingcreatedbyaman.Theplaintiffbegantotalktotheman,whomhedescribedasbeingveryirateandhavingtheappearanceofbeingunder ,6l28 theinfluenceofsomething.Otherofficerscametoassisttheplaintiff,andhe,alongwiththeotherofficers,setabouttophysicallysubduetheman.Theplaintifftestifiedthismanwasverystronganditrequiredaconsiderableamountofexertiontoarresthim. ` Theplaintifftestifiedhebegantosufferchestpainsduringthisfracas.Theplaintiffreturnedtohisofficebutcontinuedtosufferheartpainandwenttohishome.Theplaintiffthenwenttoalocalhospitalforcare.Hetestifiedthepainlastedapproximatelyonehourand15minutes. ` TheplaintiffwastreatedbyacardiologistintheJacksonHospitalEmergencyRoomandthenbyDr.TonyPhillips,acardiologistwhotookoverhiscare.Ultimately,Dr.AllenSpaldingperformedcoronarybypasssurgeryontheplaintiff. ` Althoughwedonotthinkinthecontextofthiscase,forpurposesofdeterminingtheissueraised,theplaintiffspasthistoryisthatsignificant,wenotethattheplaintiffhasahistoryofheartproblemsdatingbackto1988andthathewastreatedbyangioplastyinOctober1994andagaininNovember1995.TheplaintiffbegantohavesomesymptomssixweekspriortotheAugust26,1996eventandhadmadeanappointmenttoseeDr.PhillipsonAugust26,1996,thedayoftheeventinthiscase. ` ThemedicalevidenceinthiscaseconsistsofthreemedicaldepositionsandvariousmedicalrecordsofDr.PhillipsandDr.Spalding.ThemedicaldepositionswerefromDr.Spalding,acardiologistwhodidthecoronarybypasssurgery,andDr.Phillips,whotreatedtheplaintiff.Thesewitnesseswerepresentedbythedefendant.Theplaintiff--present--ed--thedepositiontestimonyofDr.PervisMilnor,Jr.,aclinicalprofessorofmedicineattheUniversityofTennesseeCollegeofMedicine,whodidnotseetheplaintiffbutreceivedthemedicalrecordsfromtheotherdoctors. ` Theunanimousviewofeachofthephysicianswasthattheplaintiffhadexperiencedanattackofanginainthecourseofthestrugglewiththemanwhowasbeingarrested.ThereisadivergencebetweenDr.Milnorandtheotherphysiciansastothenatureoftheattackandwhethertheplaintiffsustainedanypermanentdamageasaresultoftheoccurrence. ` Dr.Milnorwasoftheopinionthattheplaintiffhadsufferedmorethanthenormalanginaattackbecausethepainwaslongerindurationthanisnormalforan t;7> attackofangina.Dr.Milnordescribedtheplaintiffsoccurrenceasbeinganintermediatecoronarysyndrome,whichheappearstoconsideraheartattack.Further,Dr.Milnorsaidanytimeapersonhasananginaattack--th-is--ere---wouldbealossofhearttissue.ItappearsDr.Milnor---has-determined--theplaintiffhadaheartattackbecausehelosthearttissueasaresultofthisepisode.However,Dr.Milnortestifiedthelossoftissuebytheplaintiffwasnotdocumentedandwasestablished inferentially. ` Inarrivingatafindingofdisabilityoftheplaintiff,Dr.MilnorplacedhimintheclassIIcategoryforevaluationoftheplaintiffsheartconditionundertheAMA  ` Guidelines,whichhetestifiedisadisabilityrangefrom10to29percent.Dr.Milnor 0 wasoftheopinionthattheplaintiffhadunderlyingcoronaryarterydisease,whichwascausedbythestressofbeingapoliceofficer,andthattheeventofAugust26,1996causedtheanginaattack. ` Dr.SpaldingdidnottestifytoanydisabilityoftheplaintiffasaresultoftheAugust26,1996episode.Dr.Phillipstestifiedhewasoftheopinionthattheplaintiffsunderlyingcoronaryarterydiseasewasnotcausedbytheplaintiffsworkasapoliceofficer.Hetestifiedtheanginaattack,whichistheresultofinsufficientbloodflowtotheheartintimesofexertion,wascausedbytheexertionexpendedbytheplaintiffintryingtosubduethemanwhowasarrested.Dr.Phillipsdidnotfixanydisabilityasaresultoftheoccurrence. ` TheplaintiffassertsthatDr.Phillipstestifiedtheplaintiffsufferedthedeathofhearttissueasaresultofthisepisode.WeareunabletofindthisinDr.Phillipstestimony. ` Thetrialjudgemayaccepttheopinionofonemedicalexpertoverthatofanothermedicalexpert.Kellermanv.FoodLion,Inc.,929S.W.2d333(Tenn.1996). .(+0 ThetrialjudgeinthiscaseacceptedthetestimonyofDr.MilnoroverthetestimonyofDr.SpaldingandDr.Phillips. ` Whenthemedicaltestimonyisbasedupondeposition,asitwasinthiscase,thepanelisabletomakeanindependentassessmentofthemedicalprooftodeterminewherethepreponderanceoftheevidencelies.Cooperv.INA,884 7(4:  S.W.2d446(Tenn.1994). 95<  ` Dr.Milnordidnotseetheplaintiffinthiscaseandhistestimonyand conclusionswerebasedupontherecordsofotherphysicians.Weviewhistestimonyasbeingbasedtoa--large--extentonanassertionthattheplaintiffhadsufferedthelossofhearttissueintheepisode.Dr.Milnortestifiedthelossoftissuewasnotdocumentedbythetestsshowninthemedicalrecordsbutthatthelosswas,inhiswords, inferentiallyestablished. ` Theplaintifftestifiedabouttheeventandhisproblems.However,histestimonydoesnotshowanydisabilityarisingfromtheevent.Theplaintiffwasatthetimeofthistrial,andsofarasweknow,stillemployedinthesheriffsofficethoughheworksatalessstressfullevelthanbefore. ` Wefindtheevidencepreponderatesagainstthefindingofthetrialjudgethattheplaintiffsufferedpermanentdamageinthiscase.Wereversethejudgmentanddismissthecase. ` Thecostofthisappealistaxedtotheplaintiff. `
