TheplaintiffallegesthathesufferedaheartattackattributabletothedemandsofhisjobandthereforecompensablewithinthepurviewoftheWorkersCompensationlaw.Thewords heartattack,asalleged,aregenericallyusedandaregenerallyreferabletoanysuddenadversecardiaccondition;inthecaseatBar,theplaintiffsufferedamyocardialinfarction. <    Thetrialcourtfoundthatthe petitionforworkerscompensationbenefitsshouldbesustained,andthattheplaintiffhada60percentpermanentimpairment, =   כpresumablyattributabletohisheartcondition. Theemployerappeals,questioningthefindingthattheplaintiffsheartproblemisworkrelated.Reviewofthefindingsoffactmadebythetrialcourtisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofthecorrectnessofthefinding,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2),Stonev.CityofϜMcMinnville,896S.W.2d548,550(Tenn.1995).66X 55@ Background  Theplaintiffis63yearsoldwithasixthgradeeducation,qualifiedonlyformanuallabor.HebeganworkingatBridgestonein1972. >   כHehadsufferedfromhypertensionforseveralyears,whichwascontrolledbymedication,andhadbeenmonitoredforhighcholesterolandtriglyceridesforalongperiod.Hehadbeenadvisedbyhisphysicianthathehadsubstantialheartattackriskfactorsthatneededtobecontrolled.Hehadnohistoryofheartproblems. @ TheOccurrence  OnJune19,1992,theplaintiffwasworkinginthepartsdepartmentatϜBridgestone.Heworkedtheeveningshiftandhisjobinvolvedthereturnofitemsusedthatdaytotheshelvesinthestoreroom.Hebeganworkatnoonandbeganexperiencingsymptomsat4:30p.m.whena painshotallthewaydownmyarm,andIbrokeoutinacoldsweatandgotsoweakIcouldnthardlywalk.Anursewascalledandhewasdriventoalocalhospital.AfteroneweekhewasadmittedtoParkviewHospital,wheresurgerywasperformed.Hewasreleasedincourse,andthenretired. AbouttwoweeksbeforehisheartattacktheplaintiffreturnedtoworkfollowingastrikeatBridgestone.Althoughhetestifiedthatthepartsroomwasamess,theproofisclearenoughthattherewasnothingunusualaboutthepartsorstoreroomareaafterthestrikeandtherewasnostress,strain,hostilityoranimosityintheworkplace.Theplaintiffsjobrequiredhimtocarrypartsabouttheworkarea,includingusingthestairways.Inshort,therecorddoesnotindicatethatanythingoutoftheordinaryoccurredonJune19,1992.Thereisnoevidencewhateverofaspecificacuteorsuddenstressfulevent. @ TheMedical  Theplaintiffwaseitherseen,orexamined,ortreatedbyahostofphysicians.HisinitialtreatmentwasaffordedbyDr.Ripley,andlaterbyDrs.Whitfield,Brown,Waldo,CarlsonandRoss. ?   ׀Thirtymonthsafterhisheartattack,heconsultedDr.K.P.ChannabasappainChattanooga,anonboardcertifiedcardiologist. @    Dr.ChannabasappafirstsawtheplaintiffonAugust19,1994, forhiscontinuedmedicalcare.ThehistorytakenrevealedthatonJune19,1992theplaintiffhadaheartattackandwasgiven medicationtodissolvehisbloodclotinhisarteries.Heunderwentapulmonaryarteriogramand thenhada99percentofblockageintherightcoronaryartery.Hetestifiedthat onthatdaywhenhehadthatheartattack,itseemstheywereallonstrike. A    Whenaskedifthe circumstancesofhisworkmoreprobablythannotcausallycontributedtotheheartattack,Dr.Channabasappareplied8 Ibelievetoacertainextentthatstress...precipitatedhisheartattack. Whenaskedabout thosestresscircumstancesthathedescribedtoyouinvolvingthedifficultieswiththeUnionandthestrike,thewitnessreplied ...thismighthaveprecipitatedhisheartattack. Oncrossexamination,thewitnessconcededthattheblockageinhiscoronaryartery doesnothappenovernight,andisnotaconsequenceofwork.Heagreedthatstress didntcausetheblockage. Dr.LaurenceGrossmanwasemployedbythedefendanttoreviewthedataontheplaintiffandrenderarelevantopinion.Hehaspracticedcardiologysince1947,andfoundedtheCardiologyGroupatSt.ThomasHospitalinNashville.HeisboardcertifiedandaProfessorofCardiology.Hereviewedalitanyofmedicalrecordsappertainingtotheplaintiff.Hetestifiedthat therewasnoquestionbutthattheplaintiffslongstandinghypertensionandelevatedcholesterolandtriglycerideswere bigfactorsincausationofthis[heartattack].Hetestifiedthatthephysicaldemandsoftheplaintiffsjob playedabsolutelynoroleinhisheartattack.Hefurtherelaboratedthatexhaustivestudiesshowedthatjobstrainwasnotcorrelatedtocoronaryheartdisease. @ Analysis  Theburdenofprovingthathisheartdiseasewasaninjurybyaccidentisupontheplaintiff.Anoccupationaldiseaseisaninjurybyaccident,T.C.A.506102(a)(5),andtheplaintiffsheartdiseaseisconsideredtobeanoccupationaldiseaseifitaroseoutofandinthecourseofemployment.Krickv.CityofLawrenceburg,945S.W.2d709(Tenn.1997).ButKrick,adefinitiveworkonasubjectpreviouslyrifewithdivergentdecisions,squarelyholdsthat      0 ...heartdiseasearisesoutofemploymentonlyif(1)thediseasecanbedeterminedtohavefollowedasanaturalincidentoftheworkasaresultoftheexposureoccasionedbythenatureoftheemployment,(2)itcanbefairlytracedtotheemploymentasaproximatecause,(3)ithasnotoriginatedfromahazardtowhichtheworkerwouldhavebeenequallyexposedoutsideoftheemployment,(4)itisincidentaltothecharacteroftheemploymentandnotindependentoftherelationofemployerandemployee,(5)itoriginatedfromariskconnectedwiththeemploymentandflowedfromthatsourceasanaturalconsequence,thoughitneednothavebeenforeseenorexpectedpriortoitscontraction,and(6)thereisadirectcausalconnectionbetweenthediseaseandconditionsunderwhichtheworkisperformed.T.C.A.506301.   ForerunnercasessuchasBaconv.SevierCounty,808S.W.2d46(Tenn.1991),Stonev.CityofMcMinnville,896S.W.2d548(Tenn.1995),andahostofothers,areauthorityfortheprinciplesexpressedinsummaryforminKrick,thattheordinaryrequirementsofthejoborthedaytodaystressesinherentinemploymentdonotsatisfythestatutoryrequirementsforproofofajobrelatedinjury.Moreover,thetestimonyofDr.Chanabasappa,onwhomtheplaintiffrelies,issimplytooequivocal,especiallywhencontrastedtothetestimonyofDr.Grossman.Hisstatements Ibelievetoacertainextent,and thismighthaveprecipitatedaretentativeandcertainlynotveryweighty.Moreover,thewitnessdidnotτperhapscouldnotarticulatehowabloodclot,likelymonthsoryearsinformulation,couldmedicallyorjusticiablybeattributedtothecircumstancesoftheplaintiffswork.
