àHer€work€history€includes€a€work€study€program€at€VanderbiltÏUniversity,€primarily€clerical€in€nature.€€She€has€worked€for€Baptist€HospitalÏin€Union€City€as€an€admission€clerk,€a€clerical€position,€and€in€1988,€she€beganÍworking€for€Goodyear€Tire€&€Rubber€Company,€in€the€gift€shop.€€ShortlyÏthereafter,€she€moved€into€the€factory,€working€on€a€bias€unit,€which€involvedÏrepetitive€overhead€lifting,€twisting€and€turning.€€In€June€of€1989,€she€beganÏhaving€pain€and€problems€with€her€shoulders,€and€informed€her€supervisor,ÏDavid€œStephenson›,€of€these€problems€and€filled€out€an€incident€report€in€July,Ï1989.€€She€was€initially€seen€by€Dr.€David€St.€Clair€who€diagnosedÏimpingement€syndrome.€€Her€claim€for€workersðð€compensation€benefits€wasÏeventually€denied.Ìà àShe€continued€to€work€on€the€bias€machine€and€her€shoulder€problemsÏprogressively€worsened.€€In€1990,€she€resigned€her€position€with€the€defendantÏto€attend€school,€and€worked€part„time€for€Baptist€Hospital€in€Union€City,Ïagain€in€a€clerical€position.€€Her€shoulder€pain€and€problems€substantiallyÏimproved€while€she€was€attending€school.€€In€1992,€she€returned€to€work€forÏthe€defendant€as€a€tire€inspector€in€the€final€finish€department,€which€requiredÏher€to€pick€up,€transfer,€and€throw€tires€many€times€per€day.€€Her€shoulderÏproblems€again€worsened.€€On€October€18,€1993,€she€began€seeing€Dr.€M.€A.ÏBlanton,€an€orthopedic€surgeon€in€Union€City,€Tennessee,€who€diagnosed€herÏcondition€as€subacromial€impingement€syndrome€which€is€an€ð ðoveruseÏsyndrome€associated€with€the€type€of€work€she€was€performing€.€.€.€whichÏinvolves€ððgrinding€of€the€rotator€cuff€through€the€bursa€on€the€bottom€of€theÏshoulder€bladeðð.ðð€€€She€left€the€employment€of€the€œdefendant›€a€second€time,Ïreturning€to€school€and€the€clerical€job€at€the€hospital.€€The€pain€in€herÍshoulders€greatly€improved.€€She€continued€to€see€Dr.€Blanton,€who€opined€inÏMarch,€1994€that€ð ðshe€has€almost€a€100€percent€likelihood€of€responding€toÏconservative€treatment€alone.ððÌà àIn€late€1994,€plaintiff€once€again€returned€to€work€for€the€defendant€as€aÏforklift€driver.€€Almost€immediately,€the€pain€in€her€shoulders€increased.€€SheÏreturned€to€Dr.€Blanton€who€recommended€surgery€to€alleviate€theÏimpingement€syndrome,€noting€that€all€conservative€measures€had€failed.€ÏPlaintiff€testified€that€this€was€the€first€time€she€realized€that€her€injuries€wereÏpossibly€going€to€be€permanent€in€nature.€€On€January€19,€1995,€surgery€wasÏperformed€on€the€left€shoulder,€and€on€March€28,€1995,€surgery€wasÏperformed€on€the€right€shoulder.€€Her€recovery€from€the€surgeries€wasÏuneventful€and€she€was€released€to€return€to€work€in€late€April€1995,€and€she,Ïin€fact,€returned€to€work€for€the€defendant€as€a€stock€trucker€on€May€1,€1995.€ÏShe€was€later€transferred€to€the€bias€machine€and€worked€for€approximatelyÏthree€weeks€before€resigning€her€employment.€€She€was€last€seen€by€Dr.ÏBlanton€on€May€19,€1995,€when,€on€that€visit,€Dr.€Blanton€advised€plaintiffÏthat€she€was€physically€unable€to€perform€this€job€and€encouraged€her€to€seekÏother€employment.Ìà àOn€November€2,€1994,€she€filed€this€workersðð€compensation€complaint,Ïwhich€was€heard€on€December€5,€1996.€€The€issues€before€the€court€wereÏwhether€the€plaintiffððs€claim€for€workersðð€compensation€benefits€was€barred€œby›Ïthe€statute€of€limitations€and,€if€not,€the€extent€of€the€plaintiffððs€permanentÍpartial€disability,€if€any.€€Dr.€Blanton€testified€at€length€regarding€theÏdevelopment€and€nature€of€plaintiffððs€impingement€syndrome,€as€illustrated€byÏthe€following€testimony:ÌÓ  ÓÓÓà8 àQ:à8 à.€.€.€I€think€the€meaning€is€clear,€but€to€make€sure,€itÏis€the€fact€that€this€is€heavy€repetitive€type€work€thatÏover€a€period€of€time€has€developed€this€condition€inÏthis€young€lady,€is€that€a€true€statement?ÌÌà8 àA:à8 àYes.ÌÌà8 àQ:à8 àWould€you€also€agree€that€.€.€.€there€was€a€constantÏinsult€on€her€shoulders€that€made€this€a€progressivelyÏworsening€condition,€would€you€agree€with€that?ÌÌà8 àA:à8 àYes€.€.€.€ÌÌà8 àQ:à8 à[œC]ouldnððt›€we€say€that€the€last€injurious€exposure€thatÏthis€lady€suffered€was€that€hard€work€she€was€doingÏprior€to€the€surgeries€that€you€performed?ÌÌà àA:à àYes.ÌÌÓ  ÓÓÓà àAdditionally,€Dr.€Joseph€Boals€also€testified€on€behalf€of€the€plaintiff,Ïnoting€that€the€cause€of€her€injuries€was€the€result€of€ð ðthe€repetitive€work€sheÏdid€at€Goodyear€over€a€number€of€years.ððÌà àOn€the€issue€of€permanent€impairment,€Dr.€Blanton€opined€that€theÏplaintiff€sustained€a€one€to€four€to€five€percent€disability€to€each€upperÏextremity€based€on€lost€range€of€motion€and€instability.€€He€opined€that€ð ðtheÏtype€of€work€that€she€has€been€trying€to€do€at€Goodyear€is€not€compatible€withÏher€physical€capabilities€.€.€.€I€would€strongly€suggest€that€she€pursue€thatÏchange€of€career€description€.€.€.€all€she€needs€is€to€get€away€from€that€type€ofÏwork€to€probably€regain€physical€continuity.ðð€€Dr.€Boals€testified€regardingÍimpairment,€finding€that,€based€upon€his€examination€of€the€plaintiff,€sheÏretained€ten€percent€permanent€partial€impairment€to€each€upper€extremity€as€aÏresult€of€the€injury€she€sustained€while€working€for€the€defendant.€€He€alsoÏencouraged€her€to€ð ðeliminate€repetitive€or€heavy€lifting€from€the€œwaist›€levelÏup.ððÌà àPlaintiff€testified€that€she€still€experiences€ð ð[œs]tiffness›,€pain,€difficultyÏrotating€my€shoulders,€difficulty€lifting€things,€difficulty€doing€my€own€workÏin€class,€I€have€to€ask€my€professor€to€let€me€write€my€papers€.€.€.€[instead]€ofÏtyping€them€out.ððÌÓ  ÓÓÓà8 àQ:à8 àCan€you€raise€your€arm€up€and€put€it€behind€you?€ÏDo€you€have€that€type€of€motion?ÌÌà8 àA:à8 àItððs€very€painful€for€me€to€do€that.ÌÌà8 àQ:à8 àYou€can€do€it€but€it€hurts?ÌÌà8 àA:à8 àIt€hurts€.€.€.€Ìà8 àÌà8 àQ:à8 àGive€us€some€examples,€if€you€can,€of€any€type€ofÏphysical€activity,€leisure,€sports.ÌÌà8 àA:à8 àI€used€to€like€to€play€tennis,€I€canððt€do€that,€I€canððtÏride€my€bike€.€.€.€I€can€no€longer€swim.ÌÌÓ  ÓÓÓà àFollowing€the€introduction€of€the€medical€evidence€and€the€testimony€ofÏthe€plaintiff,€the€trial€judge€held€that€the€plaintiffððs€lawsuit€was€timely€filed€andÏthat€the€plaintiff€was€entitled€to€25€percent€permanent€partial€disability€to€theÏbody€as€a€whole€as€a€result€of€injuries€sustained€while€working€for€theÏdefendant.Ìò ðafter€theÏoccurrence€of€the€injury.ðð€€T.C.A.€ðð€50„6„224.€€The€issue€is€one€of€law,ÏòòWhitehead€v.€Aluminum€Company€of€America,€óó361€F.œ2d›€620€(œ6th›€Cir.€1966),Ïand€the€delimiting€period€commences€to€run€from€the€occurrence€of€the€injury,Ïand€not€from€the€occurrence€of€the€accident.€€œòòGriffitts›€v.€Humphrey,€óó288ÏS.W.2d€1€(Tenn.€1955).€€Repetitive€stress€injuries€are€accidental,€and€are€notÏoccupational€diseases.€€òòBrown€Shoe€Co.€v.€Reed,€óó350€S.W.2d€65€(Tenn.€œ1Ô% € Ô961).›€ÏIt€is€well€known€that€with€repetitive€stress€injuries€the€symptoms€appear€andÏworsen€over€an€extended€period€of€time,€òòsee,€œLawson›€v.€œLear›€Seating€Corp.,óóÏ944€S.W.2d€340€(Tenn.€1997),€making€it€difficult€to€determine€when€theÏaccident€occurs.Ìà àInòò€Barker€v.€Home„Crest€Corp.,€óó805€S.W.2d€373€(Tenn.€1991),€theÏplaintiff€suffered€a€carpal€tunnel€syndrome.€€The€Supreme€Court€held€that€theÏplaintiff€suffered€a€new€injury€each€day€at€work,€and€therefore€the€ððaccidentalÏinjuryðð€occurred€on€the€date€the€plaintiff€ð ðcould€not€longer€perform€herÏwork.ðð€€òòœLawson›,€supra,óó€followed€the€rationale€expressed€in€òòBarker.€€óóWe€thinkÏthese€cases€control€the€disposition€of€the€case€at€Bar.€€The€plaintiff€sustained€aÏgradually€occurring€injury€which€eventuated€œin›€surgery€in€January€1995.€€WeÏfind€that€the€complaint€was€timely€filed.Ìò òòòà0 àà àà0 àà àà@ àThe€Extent€of€Disabilityóóó óòò€óó€Ìà àThis€issue€involves€the€award€of€25€percent€permanent€partial€disabilityÏto€the€body€as€a€whole€as€a€result€of€the€work„related€injuries€plaintiff€sufferedÏwhile€employed€by€the€defendant.€€To€determine€the€propriety€of€the€amountÏof€a€workersðð€compensation€award,€the€existence€of€permanent€impairmentÏmust€be€established€by€competent€medical€evidence.€€òòœCorcoran›€v.€Foster€AutoÏœGMC›,€Inc.,óó€746€S.W.2d€452,€456€(Tenn.€1988).€€In€the€case€at€Bar,€theÏpermanency€of€the€injury€was€established€by€all€experts€who€testified€in€theÏcase.€€The€treating€physician,€Dr.€M.€A.€Blanton,€opined€that€the€plaintiffÏsustained€a€one€to€four€to€five€percent€disability€to€each€upper€extremity€basedÏon€lost€range€of€motion€and€disability€resulting€from€the€work€injury.€€HeÏtestified€that€œð ðthe›€type€of€work€that€she€has€been€trying€to€do€at€Goodyear€isÏnot€compatible€with€her€physical€capabilities€.€.€.€I€would€strongly€suggest€thatÏshe€pursue€that€change€of€career€description€.€.€.€all€she€needs€is€to€get€awayÏfrom€that€type€of€work€to€probably€regain€physical€continuity.ðð€€Dr.€JosephÏBoals,€who€evaluated€the€plaintiff€at€the€request€of€counsel,€also€testifiedÏregarding€impairment,€finding€that€she€retained€ten€percent€permanent€partialÏimpairment€to€each€arm€as€a€result€of€the€injury€she€sustained€while€workingÏfor€the€defendant.€€He€also€encouraged€her€to€ð ðeliminate€repetitive€or€heavyÏlifting€from€the€œwaist›€level€up.ððÌà àOnce€permanency€has€been€established,€the€amount€of€vocationalÏdisability€suffered€by€the€plaintiff€must€be€determined.€€In€making€thisÍdetermination,€the€trial€court€must€decide€how€much€the€injury€impairs€theÏemployeeððs€earning€capacity,€not€the€degree€of€anatomical€impairment.€ÏòòœCorcoran›,€supra,€óóat€œ458.›€In€making€determinations,€the€court€shall€consider€allÏpertinent€factors,€including€lay€and€expert€testimony,€employeeððs€age,Ïeducation,€skills€and€training,€local€job€opportunities,€and€capacity€to€work€atÏtypes€of€employment€available€in€claimantððs€disabled€condition.€òòT.C.A.€ððóó€50„6„241(a)(1)Ô€+XÔ;Ô€+¼Ô€òòœRoberson›€v.€œLoretto›€Casket€Co.,€óó722€S.W.2d€380,€384€(Tenn.Ï1986).€In€addition,€in€determining€the€extent€of€the€disability,€the€trial€courtÏhas€the€discretion€to€accept€the€opinion€of€one€medical€expert€over€anotherÏmedical€expert.€€òòJohnson€v.€œMidwesco›,€Inc.,€óó801€S.W.2d€804,€806€(Tenn.Ï1990).Ìà àAdmittedly,€the€issue€of€excessiveness€œof€the€amount€of€permanentÏdisability€awarded€is›€a€close€one,€since€the€plaintiff€has€embarked€upon€a€newÏcareer€„€teaching€„€which€ordinarily€does€not€require€heavy€lifting€or€repetitiveÏactions.€€But€her€testimony€that€she€can€no€longer€engage€in€sports€or€leisureÏtime€activities€was€œunrebutted›,€and,€taken€as€a€whole,€we€cannot€find€that€theÏevidence€preponderates€against€the€finding€of€25€percent€permanent,€partialÏdisability.Ìà
