Thestatesproofattrialdemonstratesthatsometimebetweenapproximately6:00p.m.onFriday,November18,1994and11:00a.m.onSaturday,November19,1994,thedentalofficeofDr.MackHamiltoninFayetteville,Tennessee,wasburglarizedandacheckbookwasstolen.LaterthatSaturdayafternoon,thedefendantcashedtwochecksinFayettevillegrocerystores.BothchecksbearthesignatureofDr.Hamiltonaspayor,andthedefendantisnamedaspayee.Thedefendantpresentedhisdriverslicenseasidentificationatbothstoresandreceived$375.00incashfromonestoreand$375.00incashandmerchandisefromtheother.Thegrandjuryreturnedtwoindictmentschargingthedefendantwithburglary,theftofpropertyvaluedatlessthan$500,twocountsofforgingawriting,andtwocountsoftransferringaforgedinstrument.Thecaseswereconsolidatedfortrial,andthejuryacquittedthedefendantofburglarybutfoundhimguiltyontheotherfivecounts.Thetrialcourtmergedthetwocountsofforgingawritingintothetwocountsoftransferringaforgedinstrumentandsentencedthedefendanttoan 3.2 effectivesentenceof10tenyears,9monthsonthethreeremainingconvictions.Thedefendantchallengesneitherthevalidityofhisconvictionsnorthelengthoftheindividualsentencesbutcontendsthatthetrialcourtfailedtomakethefindingsrequiredtoimposeconsecutivesentences. CodeAnn.UUU U4035115(a)(1),(2)(1997).Moreover,thetrialcourtfoundthatthe z aggregatesentencebore arationalrelationshiptotheprovisionsofthe1989SentencingAct.# UUUUz:# Therecordbeforeusoverwhelminglysupportsthetrialcourtsfindings.Thedefendantsrecordcontainsninefelonyconvictionsincludingseveralforburglary.Hisjuvenilerecordextendsbackto1971whenhewasthirteenyearsold.Hisparolehasbeenrevokedduetonewarrestsandconvictionsatleasttwicepriortotheseoffenses.Hisemploymentrecordisspotty,andalthoughtherecordindicatesthathehasmadesomeefforttoimprovehisjobskills,hedidnotcompletetheprogramsinwhichheenrolled.Thedefendantarguesthatthetrialcourtappliednonstatutoryenhancementfactorsandconsiderationsindetermininghissentence.Apparently,heisreferringtothetrialcourtsstatementthatthedefendanthadspenthislife livingoffthehardworkofotherpeoplebystealingfromthem.ThisremarkwasmadeinreferencetothetrialcourtsdeterminationthatthedefendantwasaprofessionalcriminalwhoknowinglydevotedhislifetocriminalactsasamajorsourceoflivelihoodpursuanttoTennesseeCodeAnnotatedsection4035115(1).Therecordoverwhelminglysupportsthisconclusionaswellasthecourtsdeterminationthatthedefendantisanoffenderwhoserecordofcriminalactivityis L948 extensive.Tenn.CodeAnn.4035115(2).Moreover,thetrialjudgealsofoundthatlengthyconfinementwasnecessarytoprotectthepublicfromthisdefendantscriminalactivityandthattheoverallsentenceof10tebnnyearsand9ninemonthsisrationallyrelatedtotheprinciplesandpurposesoftheSentencingReformAct.
