CLE provides 'real' trial experience
As jury trials become less frequent, young litigators spend less and less time in the courtroom honing their skills. The TBA's Introduction to Trial Practice aims to fill that gap by recreating a "real" trial experience with seasoned lawyers, combative witnesses and a presiding judge. Attendees will observe key aspects of a basic trial including voir dire, direct and cross examination of an expert, and other areas often left out of law school curriculum. The program will be offered on March 31 in both Knoxville and Nashville.

The mother and stepfather of a nine year old boy filed a petition to terminate the parental rights of the boy's father, who was incarcerated at the time the petition was filed. The sole ground alleged in the petition was abandonment by failure to pay child support. After a hearing, the trial court terminated the father's rights. The court ruled that the ground of abandonment had been proved because there was clear and convincing evidence that the father had failed to support the mother during her pregnancy, and that the father had subsequently shown wanton disregard for the welfare of the child prior to his incarceration. The court also found that termination of the father's rights was in the child's best interest. We reverse.

| Court grants review of eight cases |
| Eight new cases have been granted review this week by the Tennessee Supreme Court, according to the Raybin-Perky Tennessee Supreme Court Hot List. Criminal case topics include partial-case expungements, sexual offense surcharges and ineffective assistance of counsel. Civil case issues include contract interpretation, contract ratification, administrative hearings, and zoning grandfather clauses. In addition to summarizing the cases, the Hot List also now includes predicted rulings for each.

| Legal Aid receives grant to help low-income children |
| The Baptist Healing Trust has awarded a $40,200 grant to the Legal Aid Society to continue collaboration between the society and Vanderbilt University's Monroe Carell Jr. Children's Hospital that helps low-income children. That partnership -- known as the Adams Kirshner Medical-Legal Partnership for Children -- helps families solve legal problems that threaten their children's basic needs and health. The grant was part of a $1.6 million giveaway to help a variety of health related charities and projects. |

| Tenn. law schools make best graduate schools lists |
The 2012 U.S. News & World Report's annual guide to U.S. graduate schools is now available and two of Tennessee's law schools make the top 20. In the best law school category, Vanderbilt University ties with the University of California at Los Angeles for 16th best. Then, in comparing clinical training programs at law schools across the country, the guide ranks the University of Tennessee College of Law in 12th place, according to the school.

| The White House announced yesterday that Lisa Monaco, a former chief of staff to FBI Director Robert Mueller and now an advisor to Deputy Attorney General James Cole, will be nominated as assistant attorney general for the Justice Department's National Security Division, which was created in 2006 to combat terrorism and other national security threats.

| New lawyer movie gets mixed reviews |
| A new movie that tells the story of Los Angeles defense attorney Mickey Haller is getting mixed reviews. Critics argue the script is "boilerplate," characters are "mundane" and the film is poorly directed. Fans call it an "intelligent mystery," a courtroom crime thriller that "for a change, made some sense" and a "surprisingly watchable mystery." Lest anyone be confused about the movie title, "Lincoln" refers to the main character's vehicle, which sports a "NTGUILTY" license plate and doubles as his law office.

| Legal industry gives more heavily to Democrats |
| Data collected by the Center for Responsive Politics suggests the legal industry now gives more heavily to Democrat political candidates. In 2010, the center found that lawyers and law firms nationwide gave nearly $48 million to congressional Democrats and just $11 million to Republicans. The numbers show a dramatic shift toward Democrats over the last six years. Prior to 2004, historical differences in giving were nominal. |
