The Memphis police officer who shot and killed Darrius Stewart has been dismissed from a civil suit filed by Stewart’s family, who hope to later file a lawsuit against both the officer and the City of Memphis, the Daily Memphian reports. U.S. District Judge Samuel “Hardy” Mays granted the “voluntary stipulation” filed by Stewart’s attorneys, dismissing Schilling. Mays had earlier ruled in favor of the city’s motion for a summary judgment, stating the plaintiffs failed to cite sufficient evidence that “the city’s policies and customs caused Stewart’s constitutional injury.”
