Our columnist Dan Holbrook is back with another installment of "Where There's a Will," on estate planning — this time about domestic assets protection trusts (DAPT). He looks at the recent case Toni 1 Trust v. Wacker. "To the extent such planning is legal and avoids any hint of fraudulent transfers," he writes in the April issue, "it may be unethical not to counsel clients on the pros and cons of DAPTs as part of their overall risk management."
