The U.S. Attorney’s Office for the Middle District of Tennessee has given official notice that it intends to appeal dismissal of its case against Kilmar Abrego García, the Nashville Banner reports in a recent newsletter. In a ruling last month, U.S. District Court Judge Waverly Crenshaw found that the government engaged in selective and vindictive prosecution when it pursued human smuggling charges tied to a November 2022 traffic stop. Crenshaw found that had Abrego García not successfully challenged his deportation to El Salvador, the government would not have filed the criminal charges. The appeal will be filed with the U.S. 6th Circuit Court of Appeals. The government still is seeking to deport Abrego García.
