Nashville election law attorney Daniel Horwitz writes in Saturday’s Tennessean that those who argue that “only citizens who participated in the governor’s race were qualified to vote on Amendment 1 …exact a heavy price from voters by conditioning their right to vote upon their participation in the governor’s race … even if he or she does not support any of the candidates listed.” In addition, Horwitz reviews findings from both state and federal courts to argue that such a requirement is likely unconstitutional.
