Thirty-three death row inmates are suing various entities in the execution process in a case that will be heard by the Tennessee Supreme Court Wednesday and Thursday in Nashville, according to a press release. The Court will consider whether the state’s execution protocol violates the Eighth Amendment and whether execution under the protocol constitutes cruel and unusual punishment under Tennessee’s Constitution. The case is being heard by the Supreme Court straight from the trial court, under a special provision that allows it to assume jurisdiction in cases of unusual public importance. The court will also hear five other cases over the two-day period.
