A federal judge will allow a lawsuit that alleges Mugshots.com, a website which posts the mugshots of arrested individuals, deliberately fails to update or correct outdated records to create incentives for arrestees to pay to have their photos removed from the website, the ABA Journal reports. “Mugshots.com promotes itself with plaintiffs’ likenesses by using the embarrassing nature of an arrest to promote the website, draw consumers, and if it is their photo or likeness, provide an easy link to removal for a fee,” U.S. District Judge Sharon Johnson Coleman wrote. Mugshots.com maintains that it has a First Amendment right to post the records.
