Michael Kestner, CEO and majority owner of PainMD, was arrested this afternoon after being indicted on allegations he attempted to defraud taxpayers by filing $38 million in false medical claims. Earlier this year, three PainMD nurse practitioners were indicted on health care fraud after being accused of pressuring patients into worthless injections just to pad profits. This is the first time Kestner will face criminal charges. Headquartered in Franklin, PainMD owned 10 clinics that treated around 4,500 patients in Tennessee, North Carolina and Virginia. Birmingham-based law firm, Maynard Cooper & Gale, has opened a Nashville branch. The expansion, which involves the acquisition of Nashville firm McKenzie Laird Ottinger & Leach, marks the 10th office opened by Maynard Cooper since its founding in 1984. The Nashville team will be experienced in corporate law and commercial real estate, adding to the firm’s mergers and acquisitions and venture capital advisory capabilities and its Corporate, Securities & Tax and Commercial Real Estate practice groups. Greg Curran, the firm’s chairman of the board, calls the Nashville move a "logical next step to support our growing client base in Tennessee and tap into the thriving business community in the city and across the state.” Read more at the Nashville Business Journal.

The Lawyers’ Association for Women (LAW) will honor new attorneys with a breakfast before they are sworn in on Nov. 7. The breakfast is free for new admittees and will feature a keynote address from Chancellor Anne Martin of the Nashville Davidson County Chancery Court, Part II. Breakfast begins at 7 a.m. at the Wildhorse Saloon in downtown Nashville. Reservations must be made by Nov. 1.

Google and its YouTube subsidiary will pay a total of $170 million to settle allegations from the Federal Trade Commission (FTC) that YouTube gathered data from children without parental consent, NPR reports. The FTC alleged in a complaint that the companies were collecting data on children by tracking users who were viewing channels directed at kids without asking their parents, violating laws that protect children's privacy. The complaint alleges that YouTube earned millions of dollars by using this information to target ads to the children. The settlement also requires YouTube to create a system that better protects the privacy of children.

Canadian-based practice management platform Clio announced today it has received $250 million in Series D funding from American growth equity firms TCV and JMI Equity. According to a press release from the company, the investment is the largest of its kind in Canadian history. Clio CEO Jack Newton writes in a blog post that the investment “will accelerate our ability, together, to make legal services accessible while also ensuring law firms thrive in the process.”
