State attorneys say an east Tennessee nurse practitioner who once prescribed a patient 51 pills a day was allowed to keep her nursing license because of a fundamental error by members of a state nursing board, Knoxnews reports. They are challenging the Tennessee Board of Nursing's decision to allow Christina Collins to continue working. Collins admitted to routinely prescribed opioids to patients she didn’t actually examine, and the Tennessee Department of Health argued her prescriptions were “so colossal” their only reasonable use would be trafficking or suicide. In new arguments filed in that case, the attorneys insist the decision should be thrown out because a single board member violated basic rules of evidence by doing her own online research, then used that research to misinform other board members about opioid prescriptions.

The U.S. Justice Department is asking federal courts nationwide to pause proceedings in cases, saying the government shutdown has restricted the ability of lawyers to perform their duties, including meeting court-ordered deadlines and communicating with attorneys across agencies, Law.com reports. “The government hereby moves for a stay of all proceedings in this case until Department of Justice attorneys are permitted to resume their usual civil litigation functions,” Justice Department lawyers wrote in papers filed today in courts across the country. The shutdown prohibits agency lawyers from working, save for limited circumstances that include “emergencies involving the safety of human life or the protection of property,” according to the notices. The federal courts themselves said they have sufficient funding to remain open for at least three weeks.

New Shelby County Criminal Court Clerk Heidi Kuhn has ordered a forensic audit of her office after finding several issues she said were troubling enough to ask for a full financial review, The Daily Memphian reports. Kuhn, who has only been in office 90 days, said her team found a number of issues, including that no payments collected from court fines had been disbursed to other county agencies since 2016, financial records were maintained in unsecured computer files and that collections on delinquent accounts ceased in 2016. The new administration also discovered checks that Kuhn said had been sitting for some time without being deposited.

Since its beginnings over a decade ago, a Memphis-area pro bono legal clinic has gone on to serve roughly 12,000 individuals in need, The Daily Memphian reports. The Saturday Legal Clinic, sponsored by Memphis Area Legal Services (MALS) and the Memphis Bar Association, has been held at the Benjamin L. Hooks Library once a month since November 2006. Firms and associations work to promote the event to ensure that 30 to 40 attorneys attend each month.

Governor-elect Bill Lee has announced the schedule for his inauguration next month, The Nashville Post reports. The events will mostly be held on Jan. 19, beginning with a worship service at the Ryman Auditorium followed by the inaugural ceremony at Legislative Plaza at 11 a.m. The oath of office will be administered by Tennessee Supreme Court Chief Justice Jeffrey Bivins.

The Supreme Court of Tennessee on Dec. 21 temporarily suspended Candace Lenette Williamson of Southaven, Mississippi, from the practice of law upon finding that she failed to respond to the Board regarding a complaint of misconduct. Section 12.3 of Supreme Court Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law in cases of an attorney’s failure to respond to the Board regarding a complaint of misconduct.

Greeneville attorney John T. Milburn Rogers died last night. He was 69. A 1974 graduate of the University of Tennessee College of Law, Rogers practiced in Northeast Tennessee for more than four decades. In 1996, Rogers became a founder of the Center for Advocacy and Dispute Resolution at the University of Tennessee College of Law, along with a handful of other preeminent lawyers and law firms. He has also served on the Board of Directors of the Center for Advocacy and Dispute Resolution since 1996. He served as president of countless associations, including his hometown’s Greeneville Bar Association, and gave back to the community as coach of the Greeneville High mock trial team for more than 14 years.
