Judge Andrew Freiberg last night declared a mistrial in the attempted extortion case against Hamilton County Commissioner Tim Boyd after jurors said they were deadlocked, The Chattanoogan reports. Jurors before dinner said in a note that eight had voted guilty and four not guilty. The ruling comes a day after Freiburg tossed out extortion charges against Boyd, allowing only the attempted extortion charge to remain. The judge said a retrial might occur in early 2019.

Nashville-based HCA Healthcare has been awarded $150 million in an arbitration case involving Aetna Inc. and related to out-of-network emergency room payments for care at some of HCA's Florida hospitals, The Nashville Post reports. Aetna officials say they plan to appeal the decision. HCA filed suit in Florida state court on Aug. 25, 2015, alleging Aetna's out-of-network benefit payments and administration practices resulted in underpayments.

After a deal to move the school to Middle Tennessee State University fell through last month, Valparaiso Law School announced it will shut down, Inside Higher Ed reports. Though officials at both schools were optimistic about the deal originally, the Tennessee Higher Education Commission voted against the transfer. The law school is working with the Higher Learning Commission and the American Bar Association to develop a teach-out plan that will ensure the remaining 100 second- and third-year students can finish their degrees.

The Association of Corporate Counsel has named Brentwood attorney Sherie Edwards as the Jonathan S. Silber Network Member of the Year. This award recognizes participation in committee leadership, contributions to recruitment and participation, efforts in developing network programs and resources; contributions to ACC/in-house practice, and contributions to the community through volunteer work or pro bono activities. Edwards has been part of the ACC Small Law Department Network's leadership team since 2012, as well as an active member of the Network Leadership Council and ACC Tennessee board of directors. Edwards also serves on the TBA Board of Governors.

The Tennessee Supreme Court has adopted proposed changes to Rules 10B and 11 of the Rules of the Tennessee Supreme Court. On Sept. 25, the court filed an order soliciting public comments on proposed amendments, receiving only one written comment during the comment period, a comment from the Tennessee Bar Association supporting the proposed amendments. Rule 10B deals with the disqualification or recusal of a judge; filing and disposition of motions and appeal, while Rule 11 pertains to supervision of the judicial system.

After suing the American Bar Association's Section of Legal Education and Admissions to the Bar over a noncompliance letter made public, Western Michigan University Thomas M. Cooley Law School has dropped the lawsuit, which alleged Higher Education Act and common law due process violations, The ABA Journal reports. “The circumstances that led to the litigation have been largely resolved and there was simply no point in continuing. Importantly, we have had very cordial communication with representatives from the ABA Council on Legal Education and Admission to the Bar. WMU-Cooley is committed to pursuing a collaborative approach in working with the Council, to continue meeting ABA standards,” the school's interim president, Jeff Martlew, said in a statement.

Christopher McLawhorn was today sentenced to life in prison for the premeditated murder of Nashville nurse Tiffany Ferguson, The Tennessean reports. McLawhorn was previously found guilty of sneaking into Ferguson’s home with the intent to rob her. When she confronted her intruder, McLawhorn stabbed her to death.

Judge Andrew Freiberg has tossed out Hamilton County Commissioner Tim Boyd’s extortion charge and said jurors can consider a lesser-included charge, The Times Free Press reports. Boyd pleaded not guilty yesterday to threatening Brent Lambert, the outgoing Mayor of East Ridge, to drop out of their race earlier this year. Freiberg said the evidence didn’t show Boyd communicated a threat to Lambert, but said there was a lot of evidence that could show Boyd made phone calls in hopes of gaining an advantage. Freiberg is allowing the case to go forward as attempted extortion.

Local Department of Justice officials will participate in a national Election Day program to combat election fraud and voter discrimination, The Nashville Post reports. U.S. Attorney for the Middle District of Tennessee, Don Cochran, said assistant U.S. attorneys will handle the district’s overseeing of election fraud and voting rights abuse complaints. Election Day is Nov. 6.

A key witness testified yesterday in the murder case of Memphis Police officer Sean Bolton, saying that while he stepped outside of his home on Aug.1, 2015, for a cigarette, he saw Tremaine Wilbourn shoot the officer. The Commercial Appeal reports that Wilbourn, charged with first degree murder, could face the death penalty if convicted. Another witness testified this week, offering an account of Bolton’s alleged shooting by Wilbourn, but the media was not allowed to record him or use his name because he claimed his life was in danger by testifying.
