The Nashville Scene has taken an in-depth look into the recent Board of Professional Responsibility ethics opinion, which says prosecutors must hand over all evidence that is in some way favorable to a defendant, no matter if they believe it would affect the outcome or not. Prosecutors say it would be a new “tactical weapon” that would “only create confusion,” while defense attorneys say defendants are entitled to know all of the facts. The battle over this year’s opinion has earned national coverage, including from The Marshall Project last month.

Former campaign chairman for President Trump, Paul Manafort, pleaded guilty in federal court today as part of a plea agreement, Fox News reports. Manafort will avoid a second trial and will cooperate with Special Counsel Robert Mueller’s investigation into Russian interference into the 2016 election. Manafort faced seven counts of foreign lobbying violations and witness tampering. In a separate trial in August, Manafort was found guilty of eight counts of federal tax and banking crimes.

U.S. Supreme Court nominee Brett Kavanaugh today denied an allegation of sexual misconduct from a woman who claimed he attempted to rape her when they were both in high school, Reuters reports. “I did not do this back in high school or any time,” Kavanaugh said. Sen. Chuck Grassley, Republican chairman for the Senate Judiciary Committee, said this allegation should not halt Kavanaugh’s confirmation proceedings.

A district judge in Iowa has vacated a couple’s divorce decree because it was ghostwritten by a lawyer without the knowledge of opposing counsel, The ABA Journal reports. A review of now-retired Judge Edward Jacobson’s decisions released in June had found he failed to notify opposing parties in at least 13 cases that he was using proposed rulings written by lawyers. Most of the rulings were in family law cases. Jacobson said in a deposition that he believed it was common practice to accept ghostwritten rulings in his district, but the June report said other judges in the district who asked for ghostwritten orders had notified all parties.

Administrative Office of the Courts Director Deborah Taylor Tate was recently honored at a reception held by Women in Numbers, a nonpartisan organization dedicated to supporting women in public office. Tate was recognized for her many years of leadership in public service, which has included three-and-a-half years at the AOC, a term as an FCC commissioner, and a term as president of the Court Appointed Special Advocates board, among many other accomplishments.

The Nashville Bar Association released the results today of a member poll for candidates being considered for the 20th Judicial District Criminal Court Vacancy in Davidson County. Of the three candidates, Cynthia Chappell was the favorite, with nearly 49 percent "highly" recommending her. Twelve percent would "highly recommend" Jennifer L. Smith, and 9 percent would do the same for Dominic J. Leonardo.

The FBI is searching for victims of a man who scammed 22 people out of $340,000 in a fake investment scheme targeting members of a Pigeon Forge church, Knoxnews reports. Kanwar Sarabjit Singh told various stories, including that he was making a movie for Disney and that he had a business in Tennessee setting up security for hotels. He convinced church members to pay him thousands of dollars with the promise of much more in returns. The details of the scheme are described in a plea agreement Singh reached in relation to another fraud case in which he pleaded guilty to defrauding people seeking to obtain U.S. visas.

American Bar Association President Bob Carlson yesterday urged the U.S. House Judiciary Committee to pass the Second Chance Reauthorization Act, which would renew funding for programs aimed at easing former prisoners’ re-entry into society. “These programs increase public safety and reduce recidivism by helping men, women and juveniles transition from correctional confinement to productive lives,” Carlson wrote. “The total number of Americans in prisons and jails has declined over nine straight years, in part due to ‘smart on crime’ policies like the Second Chance Act.”
