Join bar associations across Tennessee for a Seersucker Flash Mob on Aug. 31. The Knoxville Bar Association's flash mob will meet at 11:45 a.m. in the courtyard of the U.S. District Court for a group photo. Participants for the Nashville Bar Association mob will gather in front of Woolworth’s on 5th at noon for a group photo and to "pass the hat" to raise a money for the Legal Aid Society. The Memphis Bar Association will meet at the Peabody Hotel at noon and will collect contributions for Memphis Area Legal Services and A Step Ahead.

The Tennessee Department of Correction moved Billy Ray Irick to death watch on Monday night, Knoxnews reports. He is scheduled to die tomorrow by lethal injection for the rape and murder of a 7-year-old girl in 1985. His execution is controversial due to the ongoing legal battle surrounding the state’s three-drug lethal injection cocktail, which has been criticized as amounting to “torture” by some advocates.

Nashville District Attorney Glenn Funk’s office has released surveillance video of the July 26 fatal shooting of Daniel Hambrick by a Metro Nashville Police officer, The Tennessean reports. The video shows a man running away from Officer Andrew Delke before he falls to the ground. Nashville Mayor David Briley released a statement calling for MNPD to “undergo a comprehensive review.” The Tennessee Bureau of Investigation is currently looking into the incident.

The Supreme Court of Tennessee today temporarily suspended Davidson County lawyer Judson Wheeler Phillips from the practice of law upon finding that Phillips poses a threat of substantial harm to the public. Section 12.3 of Supreme Court Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law if an attorney poses a threat of substantial harm to the public. Phillips is immediately precluded from accepting any new cases, and he must cease representing existing clients by Sept. 7.

The 1940 homicide of civil rights activist Elbert Williams has been reopened in Haywood County, The Jackson Sun reports. Garry Brown, District Attorney for the 28th Judicial District of Tennessee, today reopened the investigation into the unsolved homicide. Elbert Williams is recognized as the first known NAACP member to be killed for his civil rights work. Williams was a participant in the Brownsville NAACP branch’s 1940 effort to register African-American voters.

Three federal judges from the 6th Circuit Court of Appeals heard oral arguments from attorneys in ousted lawmaker Jeremy Durham’s appeal to continue receiving benefits from the state, The Tennessean reports. Durham’s attorney Bill Harbison argued that that his client was deprived of due process after U.S. District Judge Aleta Trauger dismissed his case back in December. Janet Kleinfelter, representing the state’s Department of Finance and Administration commissioner, Treasurer and Director of Legislative Administration, argued that Durham’s lawsuit was inappropriate because he did not adequately say why he should still receive state benefits.

The TBA Young Lawyers Division is seeking volunteers for an expungement clinic Aug. 18 in Nashville. The clinic will be held at New Covenant Christian Church, 2201 Osage Street. Sign-in for the pre-registered participants begins at 9 a.m. and the clinic will start at 10:15 a.m., running until noon. All volunteer attorneys are asked to arrive at 9:30 a.m. for orientation and the run of the day. The Criminal Court Clerk’s office will have computers and the ability to process the expungement paperwork right on the spot. Those available to help should contact Amber Floyd.

The Trial Court Vacancy Commission today selected R. Michelle Blaylock-Howser of Christiana, Lisa Ann Eischeid of Murfreesboro and Darrell L. Scarlett of Murfreesboro as finalists for the new judicial post in the 16th Judicial District, which covers Cannon and Rutherford counties. The new judicial position was created by Chapter 974 of the Public Acts of 2018 and is effective Sept. 1. The nominees now go to Gov. Bill Haslam for his consideration.
