President Donald Trump today granted clemency to a 63-year-old Tennessee woman who was convicted in 1996 for her role in a cocaine distribution ring, BBC News reports. Alice Marie Johnson’s case was advocated in part by reality TV start Kim Kardashian West, who met with the president personally to lobby for Johnson’s release.

The TBA Young Lawyers Division on Tuesday presented its annual CASA Volunteer of the Year award to Julia Hearnsberger of Fayetteville. Hearnsberger has been volunteering at the Junior’s House Child Advocacy Center for more than three years, where she helped start the CASA program. In addition to serving as a child advocate, she mentors other CASA volunteers and fundraises for the organization. Hearnsberger was honored alongside Junior’s House Executive Director Crystal Guess and Volunteer Supervisor Bonnie Sullivan.

The Tennessee Supreme Court has unanimously held that after the expiration of the one-year statute of limitations, a plaintiff cannot amend her health care liability suit to substitute a health care provider to which the plaintiff had not given pre-suit notice as required by state law. The Tennessee Health Care Liability Act requires a plaintiff with a potential health care liability claim to give pre-suit written notice at least 60 days before filing a lawsuit to each health care provider that will be named as a defendant. When a plaintiff complies with the pre-suit notice requirement, the one-year statute of limitations for the filing of claims is extended by 120 days. A court can dismiss a lawsuit if the plaintiff fails to give pre-suit notice to a health care provider before filing suit. Pre-suit notice to a defendant encourages the investigation, negotiation, and possible settlement of a health care liability case before the plaintiff files suit.

Shelby County Chancellor Walter Evans has ruled that M. LaTroy Alexandria-Williams can run as a Democrat against U.S. Rep. Steve Cohen, The Commercial Appeal reports. The Tennessee Democratic Party tried to remove Alexandria-Williams' name from the Ninth Congressional District primary ballot due to violating party bylaws by supporting Republican candidates. Alexandria-Williams argued that removing his name from the ballot after the filing deadline would violate his constitutional right to seek public office.

A new program presented by the TBA's recently formed Adoption Law Section will focus on changes to adoption law including a session about modifications to Tennessee's Adoption Code and the First in Adoption Act sponsored by the TBA in this year’s General Assembly. Practice leaders on June 28 will give a special session about effectuating legislative change with an emphasis on grass roots involvement. Lunch will be included with registration, and the forum will be followed by a social hour.

Each year at TALS' Equal Justice University Conference three Access to Justice Awards are given to celebrate the outstanding work by members of the community. Nominations for the Janice M. Tennessee attorneys are invited to a happy hour reception highlighting Tennessee Justice Center's service to clients in Memphis and beyond, and honoring the recipients of its Pro Bono Attorney of the Year and Pro Bono Firm of the Year Awards. The TBA YLD is seeking volunteer attorneys for an expungement clinic in Nashville on Saturday at Village Church at Fifty Forward, 301 Madison Street. The clinic will have registration for the pre-registered participants at 9 - 10 a.m. and the clinic will start at 10:15. All volunteer attorneys are asked to arrive at 9:30 - 10 a.m. for orientation and the run of the day. Anyone interested in volunteering should contact Amber Floyd.

The Tennessee Supreme Court today suspended Casey Eugene Moreland from the practice of law until further orders of the court. Moreland was suspended based upon pleading guilty to obstruction of an official proceeding, conspiracy to retaliate against a witness, victim, or informant, conspiracy to commit theft, embezzlement, or conversion of over $5,000 in funds from an organization receiving over $10,000 in federal benefits, destruction of records or documents with the intent to obstruct a federal investigation, and tampering with a witness by corrupt persuasion. The Supreme Court ordered the board to institute a formal proceeding to determine the extent of final discipline to be imposed as a result of Moreland being found guilty.

The Tennessee Bar Association is soliciting the comments of all Tennessee-licensed attorneys who represent the indigent under Tennessee Supreme Court Rule 13. In the state budget for the 2018-19 fiscal year, which begins July 1, the Tennessee General Assembly appropriated $9.7 million in additional recurring funding to compensate Tennessee lawyers for representing the indigent under Tennessee Supreme Court Rule 13. On May 25, the Court issued an order soliciting public input on amending Rule 13 to adjust the hourly rates and per-case caps for this work. The TBA intends to provide comments. If you handle matter for which you are compensated by the state under Supreme Court Rule 13, please provide us your comments here before June 8.
