Maury County Commission Chairman Michael Fulbright says he will seek the Republican nomination for Tennessee House District 64, Humphrey on the Hill reports. Fulbright is running for a seat that will be open due to the impending retirement of Rep. Sheila Butt, R-Columbia. House District 64 includes much of rural Maury County.

Sean K. Hornbeck of Nashville was disbarred from the practice of law by the Tennessee Supreme Court on Friday. Hornbeck convinced an investor to entrust him with between $5,000,000 and $5,500,000 on the basis that he would hold the money in his trust account, it would never be at risk and the investor would reap substantial dividends. Instead, Hornbeck released most of the money to unknown third parties and/or misappropriated it to his own use. In an effort to conceal his actions, Hornbeck submitted falsified bank records and false testimony in Chancery Court. He also failed to diligently represent two clients and failed to adequately communicate with them. While Hornbeck was temporarily suspended, he also engaged in the unauthorized practice of law while in the employ of an attorney, and engaged in a scheme to misappropriate funds from a client of that attorney.

Robin K. Barry, formerly of Nashville and now of Richmond, Texas, was disbarred from the practice of law by the Tennessee Supreme Court on Friday. Barry received $100,000 of client funds pending the resolution of her client’s lawsuit. A hearing panel found that she knowingly converted over $14,000 of those funds while they were being held in her trust account. In addition, she commingled her personal funds in the trust account in order to replace the funds she converted. While the case was pending, Barry moved to Texas and began practicing law there but failed to tell her client that she had moved. She avoided her client’s efforts to communicate with her, and misled her in an effort to conceal the fact that the balance of the funds that should have remained after the conclusion of the lawsuit was missing from her trust account.

Former U.S. Rep. Stephen Fincher has dropped out of the race for the Republican nomination for U.S. Senate and is encouraging U.S. Sen Bob Corker to seek re-election, Knoxnews reports. "The party must get behind a candidate that can win in November and stop Democrat Phil Bredesen," Fincher said. Fincher's primary opponent was current U.S. Rep. Marsha Blackburn.

The Tennessee Supreme Court disbarred two Nashville attorneys, Sean K. Hornbeck and Robin K. Barry, revoking their law licenses. Today the court ruled unanimously to reject both attorneys’ requests to make the disbarment retroactive in order to enable them to apply for reinstatement of their law licenses sooner.

The Tennessee Uniform Unclaimed Property Act passed by the legislature in May 2017 is now in effect. Designed to improve efficiency in reporting and returning unclaimed property, the new law means that the 2018 reporting process, which is due May 1, will look different than it has in the past. The largest changes to the process come in five major areas: complicated property types, dormancy period, activity, due diligence and reporting and payment requirements. The Tennessee Treasury Division of Unclaimed Property has produced a flyer and a video with more information about the changes.

American Bar Association President Hilarie Bass released a statement today in response to proposed cuts to the Legal Services Corporation. “In the face of strong bipartisan agreement over the value of LSC’s important work, the administration’s second budget proposal to defund such services is unwarranted and should be dead on arrival.” Bass said “Studies show that every federal dollar spent on legal aid returns to communities more than three times as much in benefits such as social services.” Law.com reports that President Donald Trump's proposed 2019 budget would eliminate the Legal Services Corp., a move that the administration attempted in last year's budget proposal but abandoned after outcry from businesses and politicians.

Tennessee Attorney General Herbert Slatery wants the state Supreme Court to schedule eight death sentences before June 1, when the availability of a lethal injection drug would become “uncertain,” The Tennessean reports. Slatery made the request in a court document filed Thursday. The defendants in each of the eight cases asked the court for 14 days to file a response in opposition to the attorney general’s request. The state hasn’t put someone to death since 2009.

The Nashville Metro Council committee formed to investigate potential wrongdoing by Mayor Megan Barry met for the first time this week, and decided its first move should be to hire an attorney, WKRN reports. Vice Mayor David Briley is seeking two attorneys to assist in the investigation. The attorneys must have professional experience in conducting the investigations and have no professional, personal or political conflicts of interest. There will be a preference given for local attorneys, as well as the diversity of the attorney’s firm or practice. Interested parties should contact Vice Mayor David Briley, (615) 880-3357.
