State Rep. Courtney Rogers, R-Goodlettsville, will not seek reelection in House District 45 this year, Humphrey on the Hill reports. Rogers has served three terms in the legislature. District 45 includes parts of Sumner County, including Goodlettsville, Millersville and portions of Hendersonville.

J. Leigh Griffith and Bradley Sagraves will present a special CLE webcast on new tax laws, including the Tax Cuts and Jobs Act. State House Rep. Raumesh Akbari will run for the Tennessee Senate, LocalMemphis.com reports. Akbari has served in the House for two terms as a Democrat and is seeking the District 29 Senate seat recently vacated by Sen. Lee Harris, who resigned to run for Shelby County Mayor.

Gabriela Salinas, a three-time cancer survivor who once gained media attention while being treated at St. Jude’s Hospital as a child, has announced her candidacy for the Tennessee Senate, Humphrey on the Hill reports. Salinas will seek the Democratic nomination for the District 31 seat, currently occupied by Republican Brian Kelsey of Germantown. District 31 covers parts of Shelby County, including Germantown, Collierville and Cordova.

The Tennessee Supreme Court has issued five orders amending rules that will become effective July 1, subject to approval by resolutions of the General Assembly. The court amended the Rules of Appellate Procedure, Rule 3, appeal as of right: availability; method of initiation; and Rule 4, appeal as of right: time for filing notice of appeal. The court amended the Rules of Criminal Procedure, Rule 5, initial appearance before magistrate; Rule 16, discovery and inspection; Rule 41, search and seizure; and Rule 49.2, electronic filing, signing or verification. The court amended the Rules of Juvenile Procedure, Rule 107, subpoenas; Rule 117, entry of order; Rule 301, initiation of cases; Rule 309, agreed orders; and Rule 310, modification or or relief from judgments or orders. The court amended the Rules of Civil Procedure, Rule 24, intervention; Rule 47, jurors; Rule 54, judgment and costs. The court amended the Rules of Evidence, Rule 502, limitations on waiver of privileged information or work product.

Monroe County lawyer Barry Keith Maxwell received a public censure today from the Board of Professional Responsibility of the Tennessee Supreme Court. Maxwell commingled personal funds into his client trust account and improperly utilized the account for his own benefit by using the funds to pay his personal expenses. In mitigation, Maxwell ceased practicing law and no longer held client funds in the account when he deposited his personal funds therein. A public censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to practice law.

A complaint has been filed against the recently-resigned state Sen. Jim Tracy, who is accused of violating the federal Hatch Act by hosting a fundraiser for state Senate candidate Shane Reeves, Humphrey on the Hill reports. Tracy resigned in November to become the state director of rural development for the U.S. Department of Agriculture, and Reeves is running with Tracy’s endorsement to replace him. According to the complaint, filed by John Anderson of Bell Buckle, Tracy served as host for a Reeves fundraiser three days after accepting the job.

John Payson Matthews III of Somerville died on Jan. 2. He was 85. Matthews was a veteran of the U.S. Army, where he served in Korea along the 38th Parallel as a first lieutenant in the signal corps. After his service, he graduated from the University of Tennessee College of Law, and shortly after opened his firm on the Somerville court square. He practiced law there until December 2017. He served multiple terms on the University of Tennessee College of Law Alumni Advisory Council, as well as multiple terms as a member of the Fayette County Court. Gifts in memory of Matthews may be made to First Presbyterian Church of Somerville.

Sherra Wright, ex-wife of former NBA player Lorenzen Wright, will be extradited from California to Tennessee to face conspiracy and first-degree murder charges in the death of her ex-husband seven years ago, The Commercial Appeal reports. Wright and Billy Ray Turner, who attended the same Collierville-area church, were arrested last month and charged with killing Lorenzen Wright with premeditation.

The U.S. Supreme Court has ruled that a black Georgia death row inmate who was found guilty of kidnapping and murder in 1990 may be entitled to a certificate of appealability due to racist statements made by a juror during deliberations, the ABA Journal reports. Seven years after Keith Tharpe was sentenced to death, defense attorneys interviewed juror Barney Gattie. Among other inflammatory statements, Gattie said in a sworn affidavit that he wondered if “black people even have souls.” Tharpe petition to reopen his habeas petition last June.
