A federal judge sentenced two Chattanooga brokers to prison today after they were convicted of a wire fraud and tax evasion conspiracy, NewsChannel 9 reports. Douglas Dyer, 58, will serve 5 years in prison and James Brennan, 68, will serve 4 years. The two men must also pay $4.9 million in restitution to the over 200 victims in this case. Brennan was also ordered to pay over $184,000 in restitution to the IRS, and Dyer was ordered to pay the IRS more than $354,000. The pair admitted to conspiring to steal $4.9 million from investors and mischaracterizing the stolen money as capital gains instead of income.

The Tennessee Supreme Court ruled today that courts must consider all nine statutory factors, as well as any other relevant facts, when deciding whether terminating parental rights is in a child’s best interests. The Supreme Court explained that requiring courts to consider all relevant facts and circumstances ensures each case receives individualized consideration before fundamental parental rights are terminated. Justice Cornelia A. Clark authored the unanimous opinion.

A federal judge will allow a lawsuit that alleges Mugshots.com, a website which posts the mugshots of arrested individuals, deliberately fails to update or correct outdated records to create incentives for arrestees to pay to have their photos removed from the website, the ABA Journal reports. “Mugshots.com promotes itself with plaintiffs’ likenesses by using the embarrassing nature of an arrest to promote the website, draw consumers, and if it is their photo or likeness, provide an easy link to removal for a fee,” U.S. District Judge Sharon Johnson Coleman wrote. Mugshots.com maintains that it has a First Amendment right to post the records.

An Army specialist has pleaded guilty to killing Fort Campbell solider Pfc. Shadow McClaine, WKRN reports. Spc. Charles Robinson III said he was supposed to be paid $10,000 by McClaine’s ex-husband to kill her and hide the body. He claims he was only paid $200. He pleaded guilty yesterday to murder, conspiracy and obstruction of justice.

The Trial Court Vacancy Commission met today to consider five candidates for Circuit Court vacancy in the 17th Judicial District, representing Bedford, Lincoln, Marshall and Moore Counties. The vacancy was created when Judge Lee Russell announced he will retire effective Nov. 30. After holding a public hearing and conducting public interviews, the commission selected the following nominees: Marshall W. Burk of Shelbyville, Trisha L. Henegar of Shelbyville and John H. Richardson, Jr. of Fayetteville. The commission has forwarded the names to Governor Bill Haslam for his consideration.

The Texas Supreme Court has issued an amended emergency order that permits out-of-state lawyers to practice Texas law temporarily. The order opens up opportunities for volunteer attorneys from across the country to provide pro bono support in Texas or remotely, by working with a “legal aid or pro bono program or a bar association that provides services to victims of Hurricane Harvey." The Tennessee Bar Association is working to support pro bono legal services needed in Texas in the wake of this disaster. One such remote opportunity is for Tennessee lawyers to volunteer with Texas Free Legal Answers to respond to pro bono client questions via email. Other opportunities are available through the State Bar of Texas.

Survivors of the hurricanes in Puerto Rico can now get legal assistance by calling a hotline set up by a partnership among the Disaster Legal Services Program of the American Bar Association Young Lawyers Division, the Federal Emergency Management Agency, the Virgin Islands Bar Association Young Lawyers Division and the Louisiana Civil Justice Center. Disaster victims can now call 800-310-7029, between 9 a.m. and 4 p.m. CST Monday through Friday to reach free legal help. Find out more from the ABA's Disaster Legal Services website. Additionally, there is a continued need for legal assistance for victims of Hurricane Irma in Florida, as well as victims of hurricanes in the U.S. Virgin Islands.

The YLD hosts Wills for Heroes clinics around the state to provide free wills, powers of attorney and advance directives for Tennessee's firefighters, law enforcement officers and other emergency responders. The Wills for Heroes program started shortly after the September 11th terrorist attacks as a way to give back to first responders in need of estate planning services. Since its inception in Tennessee, Wills for Heroes has served several thousand heroes and their families.
 
Memphis Wills for Heroes Clinic – November 4
 
When: Saturday, November 4 from 9:00 a.m. to 5:00 p.m.
Where: Benjamin L. Hooks Central Library, 3030 Poplar Ave., Memphis, TN 38111
 
WE NEED YOU to assist us with drafting basic estate planning documents for our first responders, serving as witnesses to the documents, and/or notarizing the documents!  Volunteer for the morning shift from 8:45 a.m. until 1:00 p.m., the afternoon shift from 12:45 p.m. until 5:00 p.m., or stay all day.  Light snacks and lunch will be provided.
 
Some of you may also be notaries.  If you are a notary, we would love if you could bring your notary supplies with you as we may need you to serve in dual capacities!
 
Please let us know if you are able to volunteer and, if so, the shift(s) for which you are available. Attorney Volunteers are needed to assist the YLD in conducting mock interviews for law students this Fall. The interviews will be one-on-one with students who register and each will last 30 minutes. We need volunteers to sign up for at least a 2 hour shift. Please save the dates and contact Cole Rogers to volunteer or to find out more information.

TBA YLD leaders joined TBA Executive Director Joycelyn Stevenson at Belmont University College of Law this past month to speak to students about opportunities to get involved with the TBA and TBA YLD.
