Lewisburg attorney Dan. P. Whitaker died on Tuesday. He was 84. He served in the U.S. Air Force during the Korean War, and graduated from Vanderbilt University School of Law in 1962. The next year, he and Shelby Haywood formed the law firm of Haywood and Whitaker in Lewisberg. He worked in the Marshall County community for 52 years, including serving as legal counsel for the Lewisburg Water and Wastewater Board for 31 years. A visitation will be held at Bills McGaugh and Hamilton Funeral Home tomorrow from 5 p.m. until 7 p.m., and a memorial service will be held on Saturday at the First United Methodist Church, 3255 W. Church Street in Lewisburg, beginning at 11 a.m., with an additional visitation at 10 a.m.

In response to a fatal shooting in Clarksville, state Rep. Joe Pitts, D-Clarksville, will propose legislation to tighten laws governing bounty hunters and bonding agents, the Leaf-Chronicle reports. In April, four bondsmen and three bounty hunters were charged with the murder of 24-year-old Jalen Johnson Milan. An investigation found that none of the men charged had registered with the local sheriff’s office, none provided Clarksville Police with documentation about their fugitive, and some wore uniforms to appear like law enforcement.

Jacksboro attorney Wesley Lynn Hatmaker was disbarred from the practice of law today by the Board of Professional Responsibility. Hatmaker was found to have misappropriated client funds; he pled guilty to four counts of theft over $60,000 and two counts of theft over $10,000. He was also found to have failed to communicate with and diligently represent clients, failed to properly terminate his relationship with clients, practiced law while temporarily suspended and failed to respond to requests for information from the board. Hatmaker was previously disbarred in October 2016, which remains in effect.

The Tennessee Supreme Court has affirmed a 2014 disciplinary action by the Board of Professional Responsibility that found a Knoxville attorney guilty of professional misconduct. A petition for discipline filed against Danny C. Garland II alleged that while handling an adoption case, he failed to communicate appropriately with clients, failed to exercise reasonable diligence in his representation and committed professional misconduct. A hearing panel found that he should be publicly reprimanded, a ruling affirmed after Garland’s appeal to the Knox County Chancery Court. The Supreme Court's ruling agreed as well, although a dissenting opinion was authored by Justice Holly Kirby.

The American Bar Association's Division for Public Education has announced the theme for Law Day 2018: “Separation of Powers: Framework for Freedom.” The theme examines how the Constitution’s principles of separation of powers and checks and balances preserve liberty. Law Day is held on May 1 of each year to celebrate the role of law in our society and cultivate a deeper understanding of the legal system. 2018 will mark the 60th anniversary of the event.

Nashville attorney Edward Joseph Jenkins died last month on July 10. He was 87. Originally from St. Louis, Jenkins served in the U.S. Army Air Corps and received his law degree from St. Louis University School of Law in 1954. He practiced law in Nashville with Watkins and Crownover before joining Travelers Insurance Company, where he served as claims manager for the state of Tennessee. After a brief retirement in 1993, he was hired by the Metro Nashville Legal Department as a claims manager, where he worked until 2002. He was a founding member of the Nashville Claims Managers Council and served on the board of Catholic Charities of Tennessee and the Diocese of Nashville.

Former commissioner of the Tennessee Department of Agriculture John Rose has announced he will seek Tennessee’s 6th district congressional seat, currently occupied by gubernatorial candidate Diane Black, the Nashville Post reports. Rose, a Cookeville native and graduate of Vanderbilt Law School, is the president of Boson Software, an information technology training company. He served as commissioner during the Sundquist administration, and also owns one of the state’s oldest working farms, located in Smith County. State Rep. Judd Matheny, R-Tullahoma, and Cookeville blogger Christopher B. Monday have also announced they are running in the Republican primary for Black's seat.

In a new poll by The Washington Post, half of Republican respondents said they would support postponing the 2020 presidential election if President Donald Trump proposed it. The survey, conducted June 5 through June 20, found that 52 percent of respondents that identify as Republican would support postponing the election, and 56 percent said they would support it if the president and Congress were behind it. Of those surveyed, 68 percent believe that millions of "illegal immigrants" voted in the last election, and 73 percent believe voter fraud happens somewhat or very often.

The New York State Bar Association today released two ethics opinions on lawyers and "electronic marketing services," one of which found that lawyers may not ethically utilize Avvo Legal Services. According to the opinion, Avvo’s current structure requires the payment of a “marketing fee” by the lawyer, which the New York Bar’s Committee on Professional Ethics found to be an improper payment.
