After this February's Bar examination scores hit an all-time low, two-thirds of recent law school graduates think that law schools should raise their standards when deciding who is allowed to attend, Above the Law reports. Many are graduating into high levels of debt and joblessness, while law schools have steadily been lowering standards and raising tuitions. In Tennessee, the passage rate for candidates taking the bar exam in February fell to 46.8 percent, down more than four percentage points from last year. Among first time takers, the passage rate was 61.1 percent, while repeat takers passed at only a 36.1 percent rate, the Board of Law Examiners report.

A bill that would have moved many duties of the attorney general’s office to a newly created solicitor general’s office is dead for the year, the Nashville Post reports. The legislation would allow the General Assembly to jointly appoint a solicitor general, who would serve as the head of the legal department of the state. AG employees would move over to the new office and the AG would only be responsible for reporting opinions of the Supreme Court.

The defense of two former University of Tennessee football players will be allowed to go after the social media history of the woman they allegedly raped, a state appellate court ruled today. Knoxnews reports that the Tennessee Court of Criminal Appeals’ decision may aid the case of A.J. Johnson and Michael William, and also open the door for defense attorneys to directly seek social media history from witnesses without relying on prosecutors or police to do so.

A bill that creates a deadline for the Board of Parole to reconsider cases when a person has returned to prison after criminal charges have been dismissed is headed to Gov. Bill Haslam, the Tennessean reports. The measure, which passed the House unanimously on Monday, was proposed after a Tennessee man was imprisoned for a year after his case was dismissed.

Justice Cornelia Clark has been selected for the 2017 Judge Martha Craig Daughtrey Award. Judge Clark was appointed to the Tennessee Supreme Court in 2005 and was elected to a full eight-year term in August 2006. She has served longer than any other member of the current court. In 2010 she was sworn in as Chief Justice, becoming the second woman in Tennessee history to serve in that role. She also was one of the first women partners in a large law firm in Nashville, Farris, Warfield & Kanaday.

Eight attorneys are seeking to replacing Nashville General Sessions Judge Casey Moreland in special appointment by the Metro Nashville Council, the Nashville Post reports. In addition to four who previously announced their intentions –  Sam Coleman, Adam Dread, Ana Escobar and Martesha Johson – attorneys Michael Clemons, Barry Gearon, Nick McGregor and Tillman Payne have also thrown their hats into the ring. The council will appoint the interim judge on May 16. A full-term replacement will be elected in 2018.

Tennesseans who paid for the brand-name drug Provigil or its generic Modafinil from June 2006 to March 2012 are being encouraged by Attorney General Herbert Slatery to submit claims, after a court decision last year found the drug’s creator to be a part of an anticompetitive scheme. Originally, the deadline for consumers to file claims was April 13, 2017, but it has recently been extended to June 25, 2017.

The law license of David Lamar Maddox was transferred to disability inactive status on April 7. Maddox may not practice law while on disability inactive status, and only may return upon showing clear and convincing evidence that the disability has been removed.

The TBA’s 21st annual Labor and Employment Forum will be held May 8 at the Tennessee Bar Center in Nashville. Sessions will cover the latest federal and state developments, with separate emphasis on the expansion of labor laws in non-union settings, emerging gender-related issues, and the continued explosion of wage and hour litigation. Tennessee House and Senate committees both moved forward with legislation that would double the number of campaign finance audits, the Tennessean reports. Also at the legislature, the asset forfeiture bill, as amended in the House, was recommended for adoption in the Senate Judiciary Committee. The TBA-backed probate clean up legislation, sponsored by Sen. John Stevens (R-Huntington), cleared a Senate committee with minor changes.
