A check kiting scam has struck several Tennessee attorneys, and FBI agents are asking attorneys to inform authorities of instances of the scam. If a lawyer has experienced what seems to be an attempt at one of these scams, please report it to www.ic3.gov, a federal site for internet crime complaints. If a lawyer was a victim of the scam, please report the crime via the website as well as file a police report with local authorities. Since the perpetrators of these crimes live mostly overseas, prosecution can be difficult, so prevention is key. The TBA has previously reported on what to look for to spot these scams.

A twelfth lawsuit has been filed against Durham School Services and bus driver Johnthony Walker for the Woodmore Elementary bus crash, the Times Free Press reports. This one was filed on behalf of the mother of a 6-year-old that died in the crash. Meanwhile, Durham attorneys are attempting to freeze all civil litigation against Walker and themselves to protect Walker's constitutional rights. Walker faces criminal charges, and a request has been submitted to hold the civil case “in abeyance” until the criminal charges are adjudicated.

Shelby County Assistant District Attorney Steve Jones was cleared of misconduct charges today after being accused of intentionally or knowingly failing to disclose evidence in a murder case until after the trial, the Commercial Appeal reports. The trial was that of Noura Jackson, whose second-degree murder conviction was thrown out after the state Supreme Court found that District Attorney General Amy Weirich made an improper comment on Jackson’s right to remain silent and the prosecution violated Jackson’s right to due process by failing to turn over an important witness statement until after the trial.

The American Civil Liberties Union of Tennessee has joined the lawsuit accusing the city of Memphis of violating the First Amendment rights of political protestors through the use of a list of names which were deemed to require police escort through City Hall, the Commercial Appeal reports. Yesterday, Memphis Police announced they would scrub 43 of the 81 names on the original list, which was made up mostly of local political activists. MPD Director Michael Rallings claims most of the protesters were included in error.

A Memphis defense attorney appeared in Shelby County General Sessions Court today on charges of aggravated rape and aggravated assault, the Commercial Appeal reports. Arthur Horme was directed by Judge William Turner to stay away from the woman he was accused of attacking, a former girlfriend, and ordered that Horne must not possess a weapon and must carry a GPS monitor.

Blount County Bar Association YLD –  The group recently hosted a presentation for the local bar and the Public Defender’s office speak about criminal law updates. The Blount County YLD continues to have monthly meetings and plans to have another event soon with a legislative update for its lawyers. Chattanooga Bar Association YLD – The Chattanooga Bar Association YLD continues to have monthly social happy hours and quarterly Coffee Talks with local judges throughout this upcoming year. The group just completed another successful and highly competitive High School Mock Trial competition. The YLD’s next social will be March 24 at the Fix. The group has also been working on creating YouTube video presentations related to the Chattanooga Bar Association’s Know Your Rights “When You Become 18” booklet for high school students and the young lawyers will be handing out these booklets and doing presentations at local high schools this Spring.  Finally, the CBA YLD will be hosting its second Expungement Clinic in April or May with more information coming soon.

LAW WEEK: The Law Week and School Outreach Committee is seeking volunteers for the Annual Junior Judges Program during the month of April.  Volunteers spend one hour with third graders at a school in Knox County.  If you are interested in volunteering, please contact Ashley Morgan for information regarding the program.
 
The Law Week and School Outreach Committee is also seeking nominations for the Law & Liberty Award.  All nominations must be received by April 14.  The recipient should be visible to the legal profession and local bar association.  The recipient should strive to foster and to maintain good relationships between the legal profession and the community, work to advance the understanding of the law and legal processes in the non-legal community, set an example of good citizenship, give time for volunteer work, both within the legal profession and otherwise, evidence high professional standards in his or her occupation, express concern for the safeguard of personal, political, civil, and religious liberties and should be someone whose work is not normally recognized.  Nominees do not have to be attorneys to qualify for the Law and Liberty Award. Consider those individuals in your firm, in local civic and religious organizations, or in the community who have worked to improve our legal system and protect our civil liberties. Finally, please pass this request to others in your firm and ask that they also submit their suggested nominees to Ashley Morgan.

Memphis Bar Association YLD –  The Shelby County (District 14) High School Mock Trial Competition Final was held on February 22 with Judge Bobby Carter presiding. In a well-argued round, St. Mary’s (Team A) narrowly defeated St. Mary’s (Team B) for bragging rights, although both teams from St. Mary’s will now advance to the state competition.

Nashville Bar Association YLD –  The NBA YLD will be having a Happy Hour on March 13, 5:30 - 7:30 p.m. at L.A. Jackson – the rooftop bar at the Thompson Hotel in the Gulch.  The NBA YLD’s 14th Annual LogicForce Race Judicata will be held on April 8, beginning at 8 am. Both the 5K and 10K are flat, fast and certified courses that run along the Harpeth River Greenway at Edwin Warner Park. All are welcome including families, strollers and dogs.

The TBA YLD Board invites specialty and minority bars in the state to name a representative to serve as an unfunded and non-voting member of the board. The goal of the invited guest program is to increase diversity among the board and provide an opportunity for young lawyers involved in other legal organizations to have a voice in the state bar association.  See a list of all organizations invited to send representatives.

National Bar Association, Ben F. Jones Chapter – The Ben F. Jones Chapter of the National Bar Association and the Memphis Bar Association are partnering with the Cecil C. Humphreys School of Law’s Alternative Spring Break program to assist with completing the 600+ remaining forms from the Dec. 10 Expungement Clinic. BFJ needs volunteer attorneys to supervise students at the law school on March 7, March 8 and March 9.  Students will be working from 8:30 a.m. - 4:30 p.m. with an hour lunch each day. Training will be provided on Monday, March 6 at 12 noon. You are not required to attend the training to volunteer.
 
Ideally, BFJ would like to have attorney volunteers work 1.5 or 2 hour shifts, but whatever amount of time an attorney can volunteer is greatly appreciated.  The daily shifts are as follows: 8:30 - 10 a.m., 10 a.m. - 12 p.m., 1 - 2:30 p.m. and 2:30 - 4:30 p.m. Here is a link where attorneys can select availability.  Feel free to contact Amber D. More than 150 general sessions judges from across Tennessee have gathered in Nashville this week to attend the annual General Sessions Judges Conference. At the conference, judges are attending workshops and continuing legal education events.

In the wake of the Jeremy Durham audit, the Tennessee Senate approved a bill yesterday to put more restrictions on the investments legislators can make with campaign funds, Humphrey on the Hill reports. Sen. Doug Overbey, R-Maryville, introduced the bill that would require campaign funds to be deposited and maintained in a traditional bank account insured by the FDIC. The bill received near-unanimous support in the Senate, with Sen. Todd Gardenhire, R-Chattanooga, casting the only no vote.
