Volunteers Needed for Memphis Wills for Heroes Clinic

The TBA Young Lawyers Division will hold a free Wills for Heroes legal clinic tomorrow in Memphis at the Benjamin L. Hooks Library, 3030 Poplar Ave., from 9 a.m. to 5 p.m. The clinic will provide free wills, powers of attorney and advance directives for Tennessee's firefighters, law enforcement officers and other emergency responders. Attorneys who would like to volunteer or get more information should contact Memphis lawyer Chasity Grice.

Memphis City Council Passes Marijuana Decriminalization

An ordinance to lessen penalties for carrying small amounts of marijuana passed the Memphis City Council today by a 7-to-6 vote, according to News Channel 3. Memphis becomes the second city in Tennessee, after Nashville, to decriminalize small amounts of the substance, which can now be punishable by a citation and a $50 fine or community service.

In honor of Pro Bono month, Memphis Access to Justice will debut its rebrand – 2SLAC (2nd Saturday Legal Aid Clinic) this Saturday from 10 a.m. to noon at the Benjamin L. Hooks Central Library, 3030 Poplar Ave. in Memphis. Co-sponsors are the MBA Young Lawyers Division and Litigation Section. Volunteer attorneys are especially needed in the following areas: family law, bankruptcy/debt, consumer law, employment, landlord-tenant and probate. Volunteers can contact Anne Fritz, 901-527-3575. Next Tuesday, Memphis area attorneys and law students are teaming up to provide free legal aid at the Cossitt Library Pro Bono Clinic, 33 S. The Legal Aid Society of Middle Tennessee & the Cumberlands is hosting two legal clinics this week in Williamson County. On this and every Thursday, it will host the GraceWorks West Clinic from 11 a.m. to 1 p.m. at GraceWorks West, 2382 Fairview Blvd., Franklin, TN  37062. Suit Challenges How Nashville PD Responds to Complaints Against Officers

The Nashville Scene looks at a civil rights lawsuit filed by a man who claims he was falsely arrested for driving under the influence after a traffic accident in Nashville. David Shearon of Christiana was later cleared of the charges by the Tennessee Bureau of Investigation. The Scene reports that Shearon’s suit uses his incident to examine the Metro Nashville Police Department as a whole and how it responds to citizen complaints. It says that from 2011 to 2015 citizens initiated 249 complaints against MNPD officers for “obstruction of rights,” but that 98 percent of those complaints “resulted in no finding or repercussions against the officer.”

Court Amends Rule to Allow Credit Unions for IOLTA Accounts

The Tennessee Supreme Court will amend Rule 8, RPC 1.15, Rule 9, section 35.2(a) and Rule 43 to allow attorneys to deposit trust funds in federally insured credit unions, according to a court order filed today. The order comes after the Board of Professional Responsibility and the Tennessee Bar Foundation petitioned for the ruling in July.

Attorney Accused of Stealing from Church Trust Fund

A McMinn County attorney has been indicted for theft of over $60,000, following a two-year Tennessee Bureau of Investigation probe, WRCB TV reports. Larry D. Cantrell is accused of taking money designated for the Jones Chapel United Methodist Church and Cemetery fund, of which he served as a trustee. Cantrell was also charged with one count of tampering with evidence. He turned himself into TBI Agents on Monday.

House Passes Bill to Delay New Overtime Rule

The U.S. House has approved a bill that would stall the implementation of the new federal overtime rule set by the Labor Department, ABC News reports . The rule, which is currently set to go into place on Dec. 1, would extend the yearly salary threshold in which overtime pay is guaranteed up to $47,746. The bill would affect an estimated 4.2 million American workers. Supporters of the bill say that new regulations will burden small businesses and could lead to job losses. The proposal now heads to the Senate, where Tennessee Sen. Lamar Alexander is a co-sponsor of the companion legislation.

Government Reaches Settlement in Suits Against Life Care, Preston

The Chattanoogan reports that the federal government has reached a settlement in the False Claims Act case against Cleveland Tenn.-based Life Care Centers, as well as in a separate suit against company chairman Forrest Preston. Claims in the case, in which the private nursing home company was accused of overbilling the government, amount to $1.8 billion. The separate suit against Preston alleges that he “unjustly enriched” himself through unfounded claims for government reimbursement. Life Care owns facilites in 28 states, including 20 locations in Tennessee.
