Judge Denies Parental Rights in Same-Sex Divorce

A Knox County judge ruled today that in the case of a divorcing same-sex couple, only the biological mother would retain parental rights. The Knoxville News Sentinel reports that although Erica Witt and Sabrina Witt’s daughter was conceived via artificial insemination and born during the couple’s marriage, Judge Greg McMillan opined that the non-biological parent, Erica Witt, has no "contractual" relationship with the child. After making the decision, Judge McMillan put the divorce on hold to allow Erica Witt’s attorney to appeal to the Tennessee Court of Appeals. "Given the novelty of this issue, the court thinks it appropriate to see if the appellate courts want to address this," he said.

Law Camp Participants Learn About Civics, Justice System

The Tennessee Bar Association recently partnered with Lipscomb University for its annual Law Camp, held in Nashville June 6-10. The law firm Bradley Arant Boult Cummings also sponsored the program.

Each summer, Lipscomb University’s Institute for Law, Justice & Society hosts high school students from across the country to participate in a week-long residential camp that exposes them to various aspects of the legal profession. This year’s camp focused on civics and justice, with special attention paid to the question, "What is justice?"

TBA YLD Board Member Named to AILA Position

Brittany Thomas Faith, of the law firm of Grant, Konvalinka & Harrison, P.C., has been elected by her peers as Secretary of the American Immigration Lawyers Association (AILA) Mid-South Chapter and as a member of the Association’s Executive Committee.  She looks forward to serving in this important capacity.

Faith will also serve on the TBA YLD board as the incoming public service committe co-chair.

YLD Invited Guest News for May 2016

The TBA YLD Board invites specialty and minority bars in the state to name a representative to serve as an unfunded and non-voting member of the board. The goal of the invited guest program is to increase diversity among the board and provide an opportunity for young lawyers involved in other legal organizations to have a voice in the state bar association. Association for Women Attorneys (AWA) – The AWA will be having the Mary Wolff Memorial Golf Tournament to carry on the philanthropic legacy of one of its strongest members, Mary Wolff, who passed away on Christmas Eve 2015 after a battle with cancer. The Mary Wolff Memorial Golf Tournament will be held on Friday, June 3, 2016, at The Links at Galloway (lunch served at noon, shotgun start at 1 p.m., four person scramble). East Tennessee Lawyers Association for Women (ETLAW) – Just two days before the TBI publicized that 32 individuals in Knoxville had been arrested in a human trafficking operation, ETLAW’s monthly meeting featured a discussion on Human Trafficking Awareness in East Tennessee by Brooklyn Sawyers, Esq., an Assistant U.S. Attorney, FBI Special Agent Cynthia Deitle and Kate Trudell of the Community Coalition Against Human Trafficking.
 
Because of the date conflict with the TBA convention, ETLAW will not be hosting a monthly meeting in June.  Please join us Wednesday, July 20, 2016, 12:00 – 1:30 p.m. at the downtown Knoxville YWCA with guest speaker Senator Doug Overby, who will provide his annual Legislative Update.  Lunch will be available at a cost of $10.  Register at www.etlawtn.org.

Still Time to Book for the 2016 TBA Annual Convention

It is not too late to join your colleagues June 15-18 in Nashville for the 2016 TBA Annual Convention. Register by June 1 in order to get first tier discounted tickets, and by June 8 to get second tier discounted tickets.

TBA YLD to Hold Annual Meeting; Consider Bylaw Amendment

On June 17, the Tennessee Bar Association Young Lawyers Division will hold its Annual Meeting, in which all young lawyer members of the TBA are invited to attend and participate.

The meeting will take place at 4 p.m. at the Sheraton Music City Hotel in Nashville, located at 777 McGavock Pike.

At the meeting, an amendement to the Young Lawyers Division bylaws will be up for consideration. The amendment concerns changing Article XI of the bylaws regarding how the bylaws can be amended in the future. The following is the text of the proposed amendment, with changes to the current bylaw underlined:

Upon the recommendation of the Long Range Planning Committee, these Bylaws may be amended by (1) a two-thirds vote of the members of the Division present and voting at any annual membership meeting; (2) a two-thirds vote of the members of the Division present and voting at any meeting of the membership of the Division properly called by the President; or (3) a two-thirds vote of the voting members of the Board. No amendments to the Bylaws may be made until ten (10) days notice has been given to the membership as to the facts and contents of the proposed amendments. Upon such approval by the Division or Board, such amendments shall be presented for approval to the Board of Governors of the TBA and no amendment so adopted shall be effective until so approved.

New Admittees to be Sworn In

The Tennessee Supreme Court will hold a swearing in ceremony in Nashville on June 14, for new admittees to the bar. Results from the February bar exam came out last month with 193 law students passing the exam. Events on Tuesday include an open house and lunch at the TBA from 11:30 a.m. to 2 p.m. for new lawyers and their families. The ceremony will take place at 10 a.m. at the War Memorial Auditorium, located at 301 6th Ave North. 

YLD members will be on hand to congratulate these new lawyers and provide information about TBA membership. Please join us at either location if you would like to welcome these new lawyers into the legal profession.

ABA President Visits Nashville

ABA President Paulette Brown recently visited Nashville, stopping by a local Boys and Girls Club on April 29. TBA YLD board member Cherrelle Hooper (left) was able to organize the visit for Brown. Hooper is the incoming chair of the TBA YLD children's issues committee.
