Administrative Suspensions Now Online

Notice of attorneys suspended for, and reinstated from, administrative violations — including failure to pay the Board of Professional Responsibility fee, file the IOLTA report, comply with continuing legal education requirements and pay the Tennessee professional privilege tax — is now available exclusively on the TBA website.

REINSTATED

The law license of Shelby County lawyer David Gregory Hays was reinstated on Jan. 17 after he responded to the Board of Professional Responsibility regarding a complaint of misconduct. He had been temporarily suspended by the Tennessee Supreme Court on Dec. 9, 2013.

REINSTATED

The Tennessee Supreme Court reinstated the law license of James A. Meaney III of Ringgold, Ga., on Dec. 23, 2013, after he responded to the Board of Professional Responsibility regarding a complaint of misconduct.

REINSTATED

The Tennessee Supreme Court reinstated the law license of Murfreesboro lawyer Brandon Michael Booten on Nov. 27, 2013. Booten had been suspended Nov. 1, 2013, for failing to respond to the Board of Professional Responsibility regarding a complaint of misconduct. After responding, Booten petitioned the court to remove the suspension.

The following lawyers were transferred to disability inactive status pursuant to Section 21 of Tennessee Supreme Court Rule 9. They may not practice law while on disability inactive status but may petition the Tennessee Supreme Court for reinstatement upon showing by clear and convincing evidence that the disability has been removed and they are fit to resume the practice of law.

Waverly lawyer James Phillips Bradley was reinstated to the practice of law on Aug. 4 after serving his suspension and satisfying conditions that were to be completed prior to reinstatement.

DISCIPLINARY

Censured

Wilson County lawyer James Henry Flood received a public censure on Aug. 7 for failing to (1) deposit a client’s funds in his trust account and (2) remove a fee from his trust account in a timely manner. Flood entered into a contingency contract stipulating that a client would pay him 25 percent of any past due social security benefits that were recouped. The client made periodic payments to be held for expenses or for satisfaction of the contingency fee.

REINSTATED

Knoxville lawyer Whitney Suzanne Bailey was reinstated to the practice of law on May 31 by order of the Tennessee Supreme Court subject to several conditions. The conditions include an evaluation by the Tennessee Lawyers Assistance Program and engagement of a practice monitor. Bailey, who had been temporarily suspended on April 26 for failing to respond to a request for information, also was ordered to pay the costs of the proceeding.
