A news item in yesterday's issue of TBA Today highlighted a new expungement process for certain cases in the Shelby County Criminal Court. The court has asked that TBA clarify that the new automatic expungement process is initiated only after the petitioner requests it in court. The new process will allow the order to be signed by all relevant parties in the courtroom, rather than requiring the petitioner to file elsewhere. No expungements will be processed without the petitioner’s or their attorney’s express request. The new process will start March 23. It will apply only to cases that have been dismissed or identified as nolle prosequi with no costs.

News Type: Clarification

A story in the Dec. 23 issue of TBA Today has been updated to reflect new information. Knox News reported on Tuesday that Diego Hernandez Garcia of Maryville was deported to El Salvador in violation of an order from U.S. District Judge Clifton Corker. After TBA Today was published, the news outlet updated its reporting to reflect that Immigrations and Customs Enforcement (ICE) had returned Hernandez Garcia to ICE custody in Louisiana late that same day.

News Type: Clarification

A story in the Sept. 15 issue of TBA Today relied on a Daily Memphian article about the Tennessee Supreme Court’s decision not to stay a trial court decision in a lawsuit between the city of Memphis and the Memphis Police Association. That article now has been updated to clarify that the court declined to stay the decision while an appeal from the city is pending with the Tennessee Court of Appeals. The TBA also has updated its initial reporting.

A story in the Aug. 20 issue of TBA Today highlighted a number of new hires at Tennessee law schools. A new professor at Belmont College of Law was omitted. Joe Sliskovich will be teaching courses in business associations, federal income tax and business and tax planning. Previously, Sliskovich was tenured at Loyola Law School in Los Angeles. news item in yesterday's TBA Today characterized the immigrant children affected by the cancellation of a legal services contract through the Department of Health and Human Services (HHS) as being confined to the Memphis area. While the three agencies mentioned in the item are based in Memphis, they serve immigrant children located across the state.

A Tennessee Bar Journal article from the November/December 2024 issue about the Corporate Transparency Act featured in today’s issue of TBJ Select — an electronic newsletter sent to TBA members twice a month as a compliment to the print publication — was published on Nov. 1, well before a federal judge in Texas issued a nationwide injunction blocking its enforcement. The injunction from U.S. District Judge Amos Mazzant earlier this month, reported in the Dec. 4 issue of TBA Today, halts enforcement of the act while a challenge from the National Federation of Independent Business and several small businesses and nonprofits makes its way through the legal process.

News Type: Clarification

A story in yesterday’s issue of TBA Today reported that the Nashville Metro Council voted unanimously this week to appoint former Metro Councilmember Anthony Davis to the state House seat held by Democratic Rep. Bill Beck, who died earlier this month. Davis will serve in an interim capacity until a special general election is held in September. He will face three other Democrats in a special primary election on Aug. 3. The winner of that race will advance to the general election on Sept. 12. One Republican has picked up papers to run in the general election. The Nashville Post has more on the story.

A story in yesterday’s issue of TBA Today about two Jackson individuals prosecuted for bank fraud did not include details about the sentence for Benjamin Vargason. He was sentenced to time served and placed on supervised release for three years, with six months to be served in home confinement. A story in Friday’s issue of TBA Today reported that the Tennessee legislature approved several amendments to the Tennessee Supreme Court Rules. The story indicated that the amendments approved were the same as those put out for public comment. In fact, the court did change the rules package after the comment period. The language sent to and approved by the legislature did not include changes to Rule 41 of the Rules of Criminal Procedure. That rule was returned to the Rules Commission for further consideration. View the final changes to Rule 5.02 of the Rules of Civil Procedure and Rule 49 of the Rules of Criminal Procedure.

An article in yesterday’s issue of TBA Today indicated that the new law firm of Herzfeld, Suetholz, Gastel, Leniski and Wall (HSGLaW) will assume work on opioid litigation previously handled by Branstetter, Stranch & Jennings. In fact, the new firm will take over responsibility for neonatal abstinence syndrome (NAS) baby cases. Branstetter, Stranch & Jennings, which is rebranding as Stranch, Jennings & Garvey, will continue to handle governmental opioid work.
