Defendant, Jamie Rebecca Ryan, pleaded guilty in Bedford County Circuit Court to one count of possession of 0.5 grams or more of methamphetamine with intent to sell, a Class B felony. The parties agreed to an eight-year sentence, with the manner of service of sentence left to the trial court’s discretion. Following a sentencing hearing, the trial court ordered Defendant to serve her full sentence in the custody of the Tennessee Department of Correction (TDOC), consecutive to a five-year sentence for a prior unrelated offense. On appeal, Defendant argues the trial court abused its discretion in ordering Defendant to serve a sentence of full incarceration and in imposing consecutive sentences. After review, we affirm the judgment of the trial court.

Members of Tennessee’s congressional delegation recently signed on to a letter from 64 Republican members of Congress to U.S. Attorney General Merrick Garland. The letter questioned the Department of Justice’s efforts to prevent individuals entering the country illegally from registering to vote in American elections. State officials across the country have recently taken steps to investigate cases of illegal voter registration by non-citizens. According to Clarksville Online, the members expressed concerns regarding efforts to enforce laws that prohibit non-citizens from voting.

McKay's Knoxville store employees are unionizing to secure better working conditions and a stronger voice in company decisions. The recent 50th-anniversary road trip promotion, which overwhelmed staff and sent some fans to the hospital due to heat, highlighted issues like poor communication and employee strain. The union is facing challenges in contract negotiations with management, including labor charges filed with the National Labor Relations Board. “Some people think we were protesting, but it was an informational picket about us and our difficulties in bargaining with them because they are basically going as slow as possible," said Aaron Hege, a union leader who has worked at McKay's for 27 years. The Defendant, Shanada Nicole Snipes, pled guilty in the Madison County Circuit Court to aggravated robbery, aggravated assault, and multiple drug offenses. After a sentencing hearing, she received an effective ten-year sentence to be served in confinement. On appeal, the Defendant claims that the trial court erred by failing to apply mitigating factor (13) to her convictions. Upon review, we conclude that the trial court properly sentenced the Defendant. However, we also conclude that the Defendant’s conviction of possession of a Schedule II controlled substance with intent to sell in count three must be reversed and vacated because the Defendant was not charged with that offense and that the case must be remanded to the trial court for correction of the judgment in count four to reflect that the Defendant received a ten-year sentence for possession of a Schedule II controlled substance with intent to deliver. The Defendant’s convictions and effective ten-year sentence are affirmed in all other respects.

Data from the Memphis Police Department (MPD) shows that crime is down in the city for the first half of 2024. The Daily Memphian reports that overall major property and violent crimes were down 18% through the first half of the year compared to the same period in 2023; homicides are down 11% with a total of 162 homicides as of June 30 compared to 182 on June 30, 2023; robberies are down 27% at 1,041 this year versus 1,427 last year; forcible rapes were down 7%; and aggravated assaults were down less than 1%. Officials credit Operation Code Zero, a bi-weekly enforcement effort that rotates through the city’s precincts, as one of the tactics contributing to the decrease. The Memphis Shelby Crime Commission also released similar data pointing to a decrease in crime from last year, but reports that the overall crime rate is up 20% from 2020.

CLAY, Circuit Judge. Petitioner Mirvat Elgebaly, a native and citizen of Egypt, seeks review of two Board of Immigration Appeals (“BIA”) decisions in this consolidated appeal. The first decision affirmed an immigration judge’s (“IJ”) denial of Elgebaly’s two applications for a hardship waiver of the requirement that a noncitizen spouse submit a joint petition with her citizen spouse to remove conditions on her permanent resident status. 8 U.S.C. § 1186a(c)(4). On appeal, Elgebaly claims that the BIA and IJ erred in finding her ex-husband’s testimony credible, that the substantial evidence did not support denial of the hardship waivers, and that the IJ erred in failing to assist Elgebaly, proceeding pro se, in developing the record. The second BIA decision denied Elgebaly’s motion to reopen proceedings. Id. § 1229a(c)(7). Elgebaly argues that the BIA abused its discretion in considering her purportedly new and material evidence submitted with this motion. For the reasons set forth below, we DENY Elgebaly’s petitions for review.

The Defendant, Trevor Rachell Cullom, appeals from the Knox County Criminal Court’s probation revocation of the ten-year sentence he received for his guilty-pleaded conviction of attempted unlawful possession of a weapon. On appeal, the Defendant contends that the trial court abused its discretion by revoking his probation and ordering him to serve the remainder of his sentence in confinement. We affirm the judgment of the trial court.

This appeal concerns the trial court’s dismissal of a petition for an order of protection filed by the appellant husband. We affirm the trial court’s dismissal of the order of protection but reverse the trial court’s award of attorney fees to the respondent wife.

This action involves the termination of a mother’s parental rights to her minor child. Following a bench trial, the court found that clear and convincing evidence existed to establish the following statutory grounds of termination: (1) abandonment by failure to visit; (2) substantial noncompliance with the permanency plans; and (3) failure to manifest an ability and willingness to assume custody of the child. The court also found that termination was in the best interest of the child. We affirm the trial court’s decision.
