Knox County Circuit Court Judge Bill Ailor ruled yesterday that a lawsuit can proceed that will consider several questions related to the case of former football coach's wife Kelsey McCarter, including whether a 14-year-old boy is too young to consent to sex with an adult, Knoxnews reports. The lawsuit was filed by the mother of a boy who was 14 when he engaged in a sexual relationship with McCarter while living at former coach Justin McCarter's home. The suit also seeks to address whether the coach or the Knox County school system bears any responsibility in the case. Ailor's decision means the case can now proceed to a jury trial.

Both Tennessee Attorney General Herbert Slatery and American Bar Association President Bob Carlson released statements this week in support of the passage of the First Step Act, a bipartisan criminal justice reform bill that President Trump is expected to sign into law. “It is aptly named legislation, for this is a good first step in equipping those involved in the correctional system to enable better outcomes,” said Slatery. Carlson said the ABA is “proud” to support several of the bill’s provisions, including ones that ease mandatory minimum sentences and give federal judges more flexibility to make exceptions.

If Congress and the Trump Administration can’t come to an agreement on a budget by midnight tonight, the federal government could shut down, closing the U.S. Justice Department and potentially affecting the local legal community, The Tennessean reports. Federal district courts have the funding to remain open for approximately three weeks, after which they could eventually close. The U.S. Attorney’s offices will operate only with “essential” personnel, according to a spokesperson for the office in the Middle District of Tennessee.

President Donald Trump signed Congress’ omnibus Farm Bill into law this week, legalizing hemp at the federal level in a move that will surely bolster Tennessee’s burgeoning hemp and CBD industry, The Tennessean reports. The new law will make it possible to buy crop insurance for hemp, erasing some of the risk for farmers who want to expand into the new market, and allow hemp to be moved across state lines, expanding options for exports and sales. The Farm Bill removes hemp's designation as a controlled substance and reclassifies it as an agricultural product.

A federal judge in Memphis is challenging the local federal prosecutor's office, saying the prosecutors are bringing harsher charges against African-American defendants than white defendants for similar crimes, The Commercial Appeal reports. U.S. District Judge John T. Fowlkes Jr. has raised questions of racial discrimination in at least three different cases recently, including one in which a black man and a white man involved in the same drug deal were sentenced to 15 years and one year, respectively. Representatives of the prosecutor's office say they do not discriminate based on race. "We make charging decisions based on the rule of law, the facts of the case and department policy," said U.S. Attorney D. Michael Dunavant in a statement.

U.S. Supreme Court Justice Ruth Bader Ginsburg underwent surgery Friday for early stage lung cancer, NPR reports. Doctors at Memorial Sloan Kettering hospital in New York performed a lobectomy, removing one of the five lobes of the lung. Prospects look good for a full recovery, and Ginsburg hopes to be back on the court for the start of the next argument session in early January.

Baker Donelson Bearman Caldwell and Berkowitz has nixed plans to take a new Nashville office space in a planned mixed-use building One KVB Circle tower, The Nashville Post reports. The firm was to have leased 91,900 square feet of the 450,000-square-foot future tower. They are now seeking an alternative future office space.
