Members of the Metro Nashville Council will vote at their meeting tonight on a measure that would ask the city to stop investing money from its employee pension fund into for-profit prisons, WPLN reports. Councilwoman Erica Gilmore said the city has nearly $1 million invested in CoreCivic, the Nashville-based private prison company. The city disputes that claim. Supporters of the measure cite numerous reports of mismanagement and neglect that have dogged CoreCivic for several years.

Shelby County lawyer LaTrena Davis Ingram today received a public censure from the Board of Professional Responsibility. In the representation of a client pursuing a medical malpractice claim, Ingram failed to comply with Tennessee’s statutory pre-suit requirements, which led to the dismissal of the lawsuit. On appeal, Ingram failed to file a transcript or statement of the evidence as required by the Tennessee Rules of Appellate Procedure, which resulted in the dismissal of the appeal and the assessment of court costs against her client.

Knox County lawyer Brennan Patrick Lenihan today received a public censure from the Board of Professional Responsibility. In three separate cases, Lenihan engaged in a pattern of neglecting client matters. In the first case, Lenihan ignored his client’s attempts to obtain information about his case as well as requests from the Board’s Consumer Assistance Program during this time period. In the second case, Lenihan allowed deadlines that were important to his clients to pass, he did not provide them with draft pleadings as they requested, and he did not reply to a number of their text messages inquiring as to the status of the matter. In the third case, he did not complete his client’s amendment to a custody order, he ignored her numerous attempts to communicate with him, including her request for her file and a refund of fees paid, and he ignored inquiries from the Board’s Consumer Assistance Program. In addition, Lenihan failed to respond timely to a disciplinary complaint.

Carter County lawyer Dennis Dwayne Brooks on Friday received a public censure from the Board of Professional Responsibility. Brooks entered into an agreement to publish a book about the convictions of three people for murder, after he was successful in getting murder convictions as the lead prosecutor in the matters.  Brooks’ book was published prior to the conclusions of the appeals of two of the convictions. After Brooks’ book was published, one of the defendants filed a motion for a new trial and a writ of error coram nobis alleging that the book contained evidence that had not been provided to the defense. The appeals of two of the convictions were stayed for 18 months pending a hearing on these matters.

The state of Tennessee is 50th in the nation in voter turnout and 40th in voter registration, Knoxnews reports. Only 28.5 percent of Tennesseans voted in the 2014 midterm elections, according a PEW Charitable Trust analysis. Of the state’s 95 counties, only five are above the national average of 65 percent in active voter registration numbers.

Knox County Criminal Court Judge Steve Sword said that Mike Lowe should work more and spend less, but did not order more jail time for the former Knox County Trustee, Knoxnews reports. Lowe, who confessed in 2015 to stealing $750,000 in a scam he ran through his office, was arrested again for falling behind on the $1,850 in monthly payments toward the $200,000 he agreed to repay taxpayers. “It is extremely rare for imprisonment to be a just punishment for failure to pay money in a criminal action in this country,” Sword wrote in his ruling. Sword extended Lowe's probation by eight months for his delinquency.

MGM Resorts International, owner of the Mandalay Bay Resort and Casino, has filed lawsuits against the victims of the 2017 mass shooting in Las Vegas, asking federal judges to declare the company free from liability. NPR reports that the lawsuits, which name more than 800 defendants in California and more than 200 in Nevada, cite a 2002 federal law designed to encourage companies to deploy anti-terrorism security technologies without fear of being held responsible for damages if a terror attack happens. Mandalay Bay is where shooter Stephen Paddock stayed for several days before opening fire from his room onto a crowd attending a country music festival, killing 58 people.

Deportation orders in Tennessee, Arkansas and northern Mississippi have increased nearly 50 percent since 2016, The Tennessean reports. The increase can be traced to the appointment of Judge Vernon Miles, who has a track record of denying almost every asylum case, an increased number of Central American immigrants seeking asylum, and policies established by U.S. Attorney General Jeff Sessions. Tennessee’s only immigration court is in Memphis, which handles cases from four states.
