Knoxville attorney Spenser Flinn Powell died suddenly on May 29 while running a marathon. He was 28. The 2017 Valedictorian of the University of Tennessee College of Law, Powell was the only student in the history of the school to receive perfect scores in all classes. He served as a member of the National Moot Court Team and was awarded the McClung Medal, the highest award given by faculty to a member of UT’s Moot Court. He clerked for Chief Judge Thomas A. Varlan of the U.S. District Court for the Eastern District of Tennessee, and was set to join Bass Berry and Sims in Nashville upon completion of a clerkship at the 5th Circuit Court of Appeals in Houston. Funeral services will be held at Memorial Park Funeral Home in Memphis. The visitation will be June 9, at 1:30 p.m., with a funeral at 2:30 p.m. and concluding with a reception following the graveside service.

President Donald Trump yesterday expressed his disappointment with Attorney General Jeff Sessions and stated that he wished he had chosen someone else for the role, CNN reports. In response to Rep. Trey Gowdy, R-South Carolina, noting that Trump “could have picked somebody else” for the position, the president tweeted, “I wish I did!” Trump’s lawyer, Rudy Giuliani, said he does not believe his boss will fire Sessions, at least until Special Counsel Robert Mueller’s final report comes out.

A new wave of “spoofing” scams has been attacking lawyers and law firms, using fake email names to trick recipients. Emails seeming to be from a friend or colleague solicit goods, gift cards, money transfers or encourage the recipient to follow a link. One example involved a “friend” claiming he had been mugged and needs funds to pay for a hotel. Be aware and read more at the Louisiana State Bar website.

Knox County Criminal Court Judge Bob McGee will decide behind closed doors whether two former University of Tennessee football players, accused of rape, can present evidence that they say shows their accuser was engaged in an ongoing sexual relationship with one of the men. Knoxnews reports that the locked courtroom is allowed under a Tennessee Supreme Court rule enacted to protect the accuser’s privacy while allowing the accused a fair trial.

A judge has ruled that convicted Pilot Flying J executive Mark Hazelwood cannot fire his lawyer yet, Knoxnews reports. Hazelwood blamed his legal representation for his conviction and requested to replace his lawyer. U.S. Magistrate Judge Bruce Guyton pointed out federal rules set a strict procedure for changing attorneys. He also noted that a delay of Hazelwood’s sentencing hearing would push back the hearings of his 19 former subordinates, and therefore would not be an option.

The Tennessee Supreme Court heard a challenge to the state’s DUI fee system today, the Times Free Press reports. When convicted, defendants were made to pay $250 to the Tennessee Bureau of Investigation to cover the cost of a blood alcohol or drug concentration test fees. Rosemary Decosimo was convicted of driving under the influence in March 2017, and is challenging those fees, which her attorney argues encourages positive results in blood alcohol tests.

Napa Cafe will host the Mary L. Wolff Dine for Justice Dinner on Monday to support the work of Memphis Area Legal Services (MALS). Dine for Justice is named for Mary Wolff, who led MALS’s Board of Directors during its 45th anniversary year. The event will feature a four-course meal with wine pairings, and a wine pull. Monday’s dinner will be the third Dine for Justice, which was first held in 2015. Last year’s event raised over $13,000.

Nashville lawyer Paul Arthur Alexis died on May 22 at the age of 72. Born in Pittsburgh, Alexis attended Georgetown University Law Center, where he was managing editor of the law journal. He joined the law firm of Donovan, Leisure, Newton & Irvine in Manhattan before being recruited by the Nashville based Genesco Inc., as Deputy General Counsel. He subsequently joined the Nashville law firm of Boult, Cummings, Connors & Berry, where he practiced commercial litigation and served as loss prevention partner.
