The Supreme Court of Tennessee temporarily suspended Shelby County lawyer TeShaun David Moore from the practice of law today upon finding that Moore misappropriated client funds and poses a threat of substantial harm to the public. Section 12.3 of Supreme Court Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law where an attorney has misappropriated funds or otherwise poses a threat of substantial harm to the public. This suspension remains in effect until dissolution or modification by the Supreme Court.

A new American Bar Association ethics opinion stresses the importance of confidentiality lawyers must maintain when they engage in public commentary, including online on blogs and social media, the ABA Journal reports. The opinion cites the ABA Model Rules of Professional Conduct, specifically Rule 1.6(a), which provides: “A lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent, the disclosure is impliedly authorized in order to carry out the representation or the disclosure is permitted by paragraph (b).” The opinion explains that this duty of confidentiality applies even if the information about the client’s representation is found in a court record or other public record.

Nashville attorney and Vice Mayor David Briley was sworn in today as mayor of Nashville, The Tennessean reports. Briley, a former Metro Councilman At-Large, once ran for mayor himself in 2007, when he lost to Karl Dean. He is the grandson of the first mayor of the Metropolitan government of Nashville, Beverly Briley. President Pro Tempore of the Metro Council, Councilwoman Sheri Weiner, was sworn in as new vice mayor. Prior to taking up the office of mayor, Briley resigned from his position at Bone McCallester Norton PLLC.

A bill that would allow wine and liquor sales in stores on Sundays in Tennessee advanced in the legislature today, The Tennessean reported. The House State Government Committee and the Senate State and Local Government Committee passed the bill, which would allow grocery stores to sell wine on Sundays and liquor stores to remain open.

The National Conference of Women’s Bar Associations (NCWBA) has awarded the Tennessee Lawyers’ Association for Women (TLAW) with the NCWBA’s 2018 Outstanding Member Program Award for TLAW’s groundbreaking work on its Empowerment Conferences. The award recognizes innovative projects, programs, and services for organization members or the bar. Incoming TBA Young Lawyers Division president for the 2018-2019 bar year, Christian Barker, has announced that applications are now open for positions on next year’s YLD Board. All non-elected board positions are currently available. To be eligible one must be a TBA member, admitted to practice within the past five years and/or be younger than the age 36 on June 2018. Applicants must also be able and willing to attend all five YLD meetings for the bar year. Applications are to be submitted via the TBA website and are due by March 31.

Nashville Mayor Megan Barry appeared in Davidson County court today and pleaded guilty to felony theft charges related to her affair with her head of security, WKRN reports. Barry resigned as mayor of Nashville, having served less than three years of her term. She will receive three years of unsuspended probation. She will have to pay $11,000 in restitution to the city per the conditions of her plea agreement. Rob Forrest, the bodyguard whom Barry conducted an affair with, also pleaded guilty today, and must pay $45,000 back to the city as conditions of his agreement. Metro District Attorney Glenn Funk asked the Tennessee Bureau of Investigation to close its probe into Barry's affair following her resignation and plea deal, the Nashville Business Journal reports.

A federal judge has recused himself from presiding over lawsuits filed against the Hamilton County Department of Education over an Ooltewah High rape incident, The Chattanoogan reports. Judge Travis McDonough gave no reason for the recusal. The incident, in which a student was hospitalized after allegedly being brutalized on a school trip, happened just before Christmas 2015 when the boys' basketball team was staying at a cabin in Gatlinburg.
