Lawrence McKinney, the Wilson County man released from prison in 2009 after a court overturned a 1978 rape conviction due to DNA evidence, has been exonerated by Gov. Bill Haslam, The Tennessean reports. McKinney spent 31 years in prison for a crime the court determined he did not commit. He also previously saw his record expunged. The Tennessee Board of Parole voted unanimously against exoneration, but Haslam said he respected the determinations of the Shelby County Criminal Court and District Attorney General.

Capp Peterson Taylor of Dandridge was suspended today, effective immediately, for six months. Further, Taylor must pay the Board of Professional Responsibility’s costs and expenses and the court costs within 90 days. A hearing panel determined that Taylor was in an improper partnership with a non-lawyer, shared legal fees with a non-lawyer, failed to deposit retainers to a trust account and engaged in deceptive advertising. He was suspended by the Tennessee Supreme Court on Aug. 17, for failing to comply with continuing legal education requirements, which remains in effect.

Executives with Nashville-based Envision Healthcare have signed a settlement with the U.S. Department of Justice to resolve a government investigation into allegations that it potentially worked to unnecessarily boost admissions at hospitals in several states. The Nashville Post reports that the alleged impropriety occurred between the company’s EmCare division and hospitals managed by Health Management Associates. The company will pay $31.3 million to resolve the claims and avoid further litigation.

The driver of a school bus charged with killing six children was on the phone at the time of the crash, the Times Free Press reports. Hamilton County District Attorney General Neal Pinkston said that driver Johnthony Walker received a call at 3:17 p.m., and the first calls about the Woodmore Elementary bus crash came in at 3:20 p.m. The prosecution also alleges that Walker was speeding. A draft of National Transportation Safety Board report on the wreck is now in the review process and could be released in late spring. Judge Don Poole also announced during today's hearing that jurors for the trial will be brought in from Montgomery County to hear the case.

The federal law clerk handbook was revised on Monday to address sexual harassment complaints against judges, the ABA Journal reports. The revision was made to address concerns that confidentiality rules wouldn’t prevent sexual harassment claims against judges. The new passage, added to the section that covers confidentiality, reads: “However, nothing in this handbook, or in the Code of Conduct, prevents a clerk, or any judiciary employee, from revealing misconduct, including sexual or other forms of harassment, by their judge or any person. Clerks are encouraged to bring such matters to the attention of an appropriate judge or other official.”

Today the law license of George Griffin Boyte Sr. was transferred to disability inactive status pursuant to Section 27.3 of Tennessee Supreme Court Rule 9. Boyte cannot practice law while on disability inactive status. He may return to the practice of law after reinstatement by the Tennessee Supreme Court upon showing of clear and convincing evidence that the disability has been removed and he is fit to resume the practice of law.

Today the Supreme Court of Tennessee conditionally reinstated Shelby County lawyer Mark L. Pittman to the practice of law. A hearing panel found that Pittman, disbarred in 2006, had complied with the terms and conditions of his disbarment, and further found that he had demonstrated the moral qualifications required for the practice of law. Prior to his reinstatement becoming effective, Pittman must successfully complete the Tennessee Bar Examination and the Multistate Professional Responsibility Examination. He must have a practice monitor for one year, a Tennessee Lawyers Assistance Program monitoring agreement for one year, and pay $2,500 to the Tennessee Lawyers Fund for Client Protection.

Gov. Bill Haslam on Friday appointed Danny Howard Goodman Jr. of Ridgely as district attorney general for the 29th Judicial District, the State Gazette reports. Goodman replaces C. Phillip Bivens, who is retiring on Dec. 31. The 29th Judicial District includes Lake and Dyer counties. Goodman has been a General Sessions/Juvenile Court Judge for Lake County since 2002 and began serving as Municipal Court Judge for Tiptonville this year.

Former State House Rep. Billy Spivey has been disqualified from running for the District 14 state Senate seat, due to an unpaid fine to the Registry of Election Finance, Humphrey on the Hill reports. Spivey failed to pay the fine prior to the filing deadline, which would have been Thursday in the special election. Candidates who did meet the deadline include former State Rep. Joe Carr and entrepreneur Shane Reeves on the Republican side, and attorney Gayle Jordan on the Democratic side.
