Following a trial, a jury found Defendant, Richard Caldwell, guilty of felony evading arrest, reckless driving, and driving on a revoked or suspended license, for which Defendant received an effective two-year sentence. On appeal, Defendant contends that the trial court erred in denying his request for a jury instruction regarding the State’s duty to preserve evidence. After a thorough review of the record and applicable case law, we affirm the judgments of the trial court.

An employer called the police after finding company property in an employee’s purse. The employee was arrested and charged with felony theft of property. She was later acquitted. After the acquittal, the employee sued her former employer for malicious prosecution. A jury found the employer liable for malicious continuation of the criminal proceedings. Because there is material evidence in the record to support the jury verdict, we affirm.

In this divorce action, the trial court, inter alia, denied Husband any contact with the parties’ children until he follows all recommendations from a complete psychiatric evaluation and granted Wife a lifetime restraining order. Husband now appeals. We affirm the trial court’s decision to limit Husband’s parenting time pursuant to Tennessee Code Annotated section 36-6-406. We vacate the lifetime restraining order and remand for the trial court to enter a more specific order pursuant to Tennessee Rule of Civil Procedure 65.02.

In this interlocutory appeal, the employee challenges the trial court’s order canceling an expedited hearing and setting a scheduling hearing. The employee asserts the trial court’s order exceeded the limits of its discretionary authority and violated his due process rights. Upon careful consideration of the record, we affirm the trial court’s order and remand the case.

Nashville’s Community Review Board is drafting a sexual misconduct policy that members hope will be implemented by the Metro Nashville Police Department (MNPD). Even as MNPD leaders say they maintain a zero tolerance policy, the department has faced scrutiny over its handling of such complaints in recent years, and more recently as part of a whistleblower complaint. The community board says the policy would address workplace misconduct, but also would include guidelines for officer interactions with civilians, the Nashville Banner reports.

The TBA Young Lawyers Division (YLD) is launching a new CLE series designed to enhance attorney wellness by incorporating an outdoor nature component. Join the group on Oct. 23 for the first installment at Old Stone Fort State Archaeological Park in Manchester. The program will offer three hours of ethics CLE and a ranger-guided hike. Register now! The Exploration series will offer future programs at other Tennessee state parks.

The TBA Young Lawyers Division is now accepting applications for its Diversity Leadership Institute (DLI) Class of 2025. DLI is a six-month leadership and mentoring program for Tennessee law students in their second, third or fourth years of study. There are no costs to the DLI program. Class size is limited to 12 to 15 students selected from across the state. The goal of the program is to have a diverse class, so selection is based in part on race, ethnicity, gender, age, sexual orientation, gender identity, disability, background, geographical factors and law school attended.  Click here for more information. The application deadline is 5 p.m. CDT on Nov. 3. There will be a mandatory zoom meeting on Nov. 6 at 7 p.m. CST. All are encouraged to apply. This year's DLI co-coordinators are YLD Board members Brande Boyd and Cole Harrell-Morris.

Aaron Sorkin’s stage adaptation of the Pulitzer Prize winning book and Academy Award winning movie "To Kill a Mockingbird" has rekindled interest in the role lawyers play in leading their communities. This highly interactive three part series, taught by Doug Blaze and Buck Lewis — founders of the Institute for Professional Leadership at UT Law — will examine the lynching scene on the porch of the jail, the trial and the final scene on the Finch porch after an attempt on the Finch children’s lives. The second and third sessions will take virtually on Aug. 28 and Sept. 19. The full program qualifies for 4.5 dual hours of CLE. Register online for Part 2 and Part 3.
