A former Nashville Metro councilmember who now says he’s running for mayor sued the Davidson County Election Commission today to move the special election for mayor from August to May, The Tennessean reports. Ludye Wallace, current president of the Nashville chapter of the NAACP, filed the suit, which claims that he experienced a “concrete and particularized injury” as a candidate for mayor due to the Aug. 2 election date. Last week the commission set the election date for Aug. 2 to coincide with the current state primary; however, some legal observers have claimed that the resignation of former Mayor Megan Barry should have triggered an immediate special election.

The Davidson County Election Commission officially set Aug. 2 as the date for the special mayoral election to replace Mayor Megan Barry, but a legal challenge is building against that decision, The Tennessean reports. Metro attorneys in favor of the August date cite the city’s charter, which says the election to replace a mayor must take place during the next general metropolitan election as long as there’s one less than 12 months away. But attorneys Jamie Hollin and Jim Roberts both contend that the August election is not a metropolitan election, and therefore believe that the charter holds for a special election in May of this year.
