Teams Set for 2019 High School Mock Trial Competition

The teams for the 2019 Tennessee High School Mock Trial tournament have been named following district competitions held across the state. The 14 teams headed to Nashville for the state finals are Jefferson County High School, Chattanooga/Southeast TN Home Education Association (CSTHEA), Farragut High School, Signal Mountain High School, Beech High School, University School of Nashville, Westminster Academy, St. Mary’s Episcopal School, Harpeth Hall High School, Dobyns- Bennett High School, Coffee County Central High School. Agathos Classical School (Team Gondor), Agathos Classical School (Team Rohan) and Springfield High School. The teams will compete in four rounds over two days, March 22-23, at the Metro Nashville Courthouse. The Young Lawyers Division is still seeking judges, attorneys, law students and legal staff to serve as volunteers for the competition. Sign up here to take part.

ADA Saw Salary Cut After Trips with Former Judge Moreland

An assistant district attorney's salary was cut by more than $10,000 after his boss found out about a December 2016 trip he took with then-judge Casey Moreland, the Tennessean reports. ADA Ben Ford was the prosecutor assigned to Moreland’s General Sessions courtroom until he was transferred in February 2017, about the time FBI agents launched a corruption investigation into Moreland’s behavior outside of the courtroom. In a legal filing from Moreland’s criminal case, federal prosecutors said attendees on the trips took part in potentially inappropriate activities.

TBALL Session Underway in Memphis

The 2019 TBA Leadership Law (TBALL) class is currently meeting for its "Issues in Community Leadership" session in Memphis. Shelby County Mayor Lee Harris was a featured speaker to the class' meeting at Burch Porter Johnson. The class has also heard from Casey Shannon and Tommy Pacello, Monica Wharton and Judge Tim Dwyer. Tomorrow there will be presentations from Jaxon Wexler, W.J. Michael Cody and the class will take a guided tour of the National Civil Rights Museum.

Nashville Government Found in Contempt Over Airbnb Move

Metro Nashville government was found guilty of contempt of court on Wednesday for continuing to send violation notices to short-term rental operators who are appealing the city's revocation of their permits, the Tennessean reports. Chancellor Ellen Hobbs Lyle ruled in favor of seven plaintiffs fighting the city in Chancery Court to hold onto their Airbnb permits on Wednesday. She said the city should not have continued to try to stop them from operating until the court decided whether they have the right to rent their properties. The city was ordered to pay attorney fees and costs to the plaintiffs.

Party Registration Bill Advances

A new bill regarding party registration has passed the Tennessee House Elections and Campaign Finance Subcommittee, the Nashville Post reports. The bill would allow for party registration but not require it to vote in primary elections. Those who choose to register as a member of a party would be prevented from voting in another party’s primary. The legislation comes after a bill with a similar topic, which would have required party registration to vote in primaries, failed in a House committee.

Arbitrator Deals SmileDirectClub Major Victory Over Invisalign

An arbitrator has awarded Nashville-based teeth aligner company SmileDirectClub a massive legal victory in its dispute with the makers of Invisalign braces, the Nashville Post reports. The arbitrator said Align Technology broke a non-compete clause, misused confidential SmileDirectClub information and violated its fiduciary duties toward the company. The arbitrator ordered California-based Align to close its 12 retail stores — the first of which opened in late 2017 — by April 3 and extended its non-compete clause to the summer of 2022.

Local Government Forum set for April 11

Government law is an ever-changing practice area with a unique blend of constitutional, statutory and case laws. The 2019 Local Government Forum, held on April 11 at the Bar Center, will address intangibles of the practice area, along with topics such as ABC laws, government employment law, legal ethics in a government setting and more. A networking event will follow the program. Earn four hours of general CLE and two hours of dual credit.

Bill Restricting Subpoena Power for Community Oversight Boards Passes the Senate

A bill placing restrictions on civilian-led police oversight boards in Tennessee has advanced in a Senate committee, though with an amendment allowing a process for obtaining subpoenas, The Tennessean reports. The legislation initially removed all subpoena power from community oversight boards, such as the newly-created Nashville board, which was approved by 59 percent of voters in November. The bill's sponsor, Sen. Mike Bell, R-Riceville, filed the amendment after consulting with officials in Knoxville. Bell's amendment would allow an independent investigator employed by a community oversight board, chief of police or head of a police department's internal affairs division to file a petition with a judge to issue a subpoena.

TJC Names Barry to Board of Directors

The Tennessee Justice Center has named Jim Barry to its Board of Directors. Barry retired in 2018 as Chief Counsel Corporate Litigation for International Paper Company. He came to International Paper in 1999 from Union Camp Corporation, where he was Assistant General Counsel. He currently serves as Chair of the Tennessee Bar Association Access to Justice Committee and is a member of the Memphis Bar Association Access to Justice Committee. Barry is also co-chair of the Corporate Counsel Pro Bono Initiative.
